Գ. Ծառուկյանի փաստաբանական խմբի անդամի հայտարարությունը

Смбат Минасян-ը գրում է՝
Հարգելի հայրենակիցներ, որպես Գագիկ Ծառուկյանի փաստաբանական խմբի անդամ, տեղեկացնում եմ, որ այսօր՝ 2020 թվականի հունիսի 16-ին, հաղորդում եմ ներկայացրել ՀՀ գլխավոր դատախազին՝ Գագիկ Ծառուկյանի բնակարաններում խուզարկության և անվան հետ առնչվող իրադարձությունների կապակցությամբ ՀՀ ԱԱԾ առանձին պաշտոնատար անձանց կողմից ՀՀ քրեական օրենսգրքի 308-րդ և 309-րդ հոդվածներով նախատեսված առերևույթ հանցագործություններ կատարելու հանգամանքները պարզելու և քրեաիրավական գնահատական տալու համար։
Հանցագործության մասին հաղորդում ներկայացնելիս հաշվի եմ առել հետևյալ հանգամանքները․
Ինչպես արդեն հայտնվել է՝ 2020 թվականի հունիսի 14-ին Երևան քաղաքի ընդհանուր իրավասության առաջին ատյանի դատարանի որոշումների հիման վրա Գագիկ Ծառուկյանին պատկանող բնակարաններում ՀՀ ԱԱԾ տասնյակ աշխատակիցների մասնակցությամբ կատարվել են խուզարկություններ։ Բնակության վայրում խուզարկության ավարտից հետո Գագիկ Ծառուկյանը ՀՀ ԱԱԾ աշխատակիցների ուղեկցությամբ մեկնել է ՀՀ ԱԱԾ քննչական դեպարտամենտ, որտեղ անհասկանալի կերպով մեկ այլ քրեական գործով, մասնավորապես՝ նախկին ՊԵԿ նախագահ Գագիկ Խաչատրյանի և մյուսների վերաբերյալ, Էկլեն ընդդեմ Գերմանիայի (Eckle v. Germany) գործով վճռի հիման վրա, այսինքն՝ առաջացած կասկածանքի շուրջ, հարցաքննվել է որպես վկա։
Բացի այդ, ՀՀ ԱԱԾ պաշտոնական կայքէջում հրապարակել և տարածել են Գագիկ Ծառուկյանի բնակության վայրում կատարված խուզարկությամբ հայտնաբերված փաստաթղթեր, տեսանյութեր, ինչպես նաև՝ Գագիկ Ծառուկյանի կողմից առերևույթ հանցագործությունների մասնակցության վերաբերյալ թվով 3 հրապարակումներ։
Ինչպես իմ, այնպես էլ՝ պաշտպանական խմբի մյուս անդամների համոզմամբ՝ Գագիկ Ծառուկյանի բնակության վայրում խուզարկություն կատարելով /խուզարկության մասին որոշման մեջ հստակ նշված է Գագիկ Ծառուկյանի կողմից ենթադրյալ հանցագործություն կատարելու տվյալներ/, Էկլեն ընդդեմ Գերմանիայի (Eckle v. Germany) գործով վճռի հիման վրա, այսինքն՝ առաջացած կասկածանքի շուրջ հարցաքննվելով և ՀՀ ԱԱԾ հրապարակումներում Գագիկ Ծառուկյանի կողմից առերևույթ հանցագործությունների մասնակից լինելու վերաբերյալ նշումներով՝ քրեական հետապնդում է իրականացվում Գագիկ Ծառուկյանի նկատմամբ, քանի որ Եվրոպական և Վճռաբեկ դատարանների նախադեպային որոշումներում արտահայտած դիրքորոշումների համաձայն՝ դա նույնացված է «մեղադրանք» եզրույթի հետ։
Իմ կարծիքով՝ դա անթույլատրելի և անօրինական է, քանի որ չի հաղթահարվել Գագիկ Ծառուկյանի պատգամավորական անձեռնմխելիության արգելքը։
