Անընդունելի է կին պատգամավորներին փողոցից հեռացնելու եղանակը. ՄԻՊ հայտարարությունը
SOCIETYՄարդու իրավունքների պաշտպանը ամփոփիչ հայտարարություն է տարածել այսօր կատարած աշխատանքների վերաբերյալ:
«Վաղ առավոտից Մարդու իրավունքների պաշտպանի կողմից իրականացվել է այսօր տեղի ունեցած իրադարձությունների ամբողջական դիտարկում: Մարդու իրավունքների պաշտպանի ուշադրության ներքո է ՀՀ ազգային ժողովի «Բարգավաճ Հայաստան» խմբակցության ղեկավար Գագիկ Ծառուկյանի մասնակցությամբ քրեական վարույթի ընթացքը՝ օրենքով Պաշտպանին վերապահված իրավասության սահմաններում:
Մարդու իրավունքների պաշտպանի անմիջական ղեկավարությամբ՝ աշխատակազմում կազմվել է արագ արձագանքման 14 խումբ: 10 խումբ իրականացրել է այցեր Ոստիկանության Երևան քաղաքի վարչության և մարզային բաժիններ: Վերջին խումբը քիչ առաջ է վերադարձել Ոստիկանության բաժնից: Աշխատանքային 4 խումբ իրականացրել է լրատվության միջոցների ու սոցիալական ցանցերի հրապարակումների մշտադիտարկում, ինչպես նաև իրավական ապահովման աշխատանքներ:
Այսօրվա ընթացքում Ոստիկանության բաժիններ այցերի ընթացքում Մարդու իրավունքների պաշտպանի ներկայացուցիչները առանձնազրույց են ունեցել վարչական ձերբակալման ենթարկված 165 անձի հետ, ուսումնասիրվել են այդ անձանց վերաբերյալ կազմված փաստաթղթերը և նրանց բերման ենթարկելու կապակցությամբ Ոստիկանության պարզաբանումները:
Ոստիկանության բաժիններ այցերի ընթացքում Ոստիկանության ծառայողների վերաբերմունքի առնչությամբ բողոքներ առավելապես չեն ներկայացվել: Արձանագրված խնդիրները գլխավորապես վերաբերում են փողոցից Ոստիկանություն բերման ենթարկելու ու այդ ընթացքում բերման ենթարկվողի իրավունքներն ապահովելու հետ (օրինակ՝ բերման ենթարկելու հիմքերի ոչ պատշաճ պարզաբանում, մատյաններում և վարչական վարույթի նյութերում վարչական ձերբակալման հիմքերի ոչ պատշաճ արտացոլում):
Ոստիկանության բաժիններ կատարած այցերի, առանձնազրույցների և փաստաթղթերի ուսումնասիրության արդյունքները կամփոփվեն և կներկայացվեն Ոստիկանություն ամբողջական տեսքով՝ պարզաբանումների պահանջով և լուծման առաջարկներով:
Մարդու իրավունքների պաշտպանի դիրքորոշմամբ՝ պետությունը պետք է հատուկ վերաբերմունք ունենա այն անձանց նկատմամբ, ովքեր ոչ թե ակցիայի կամ զանգվածային այլ միջոցառման մասնակից են, այլ իրավապաշտպան նպատակով իրականացնում են այդ միջոցառման դիտարկում: Ուստի, Ռուբեն Մելիքյանին վարչական ձերբակալման ենթարկելու հիմքերի և եղանակի առնչությամբ Ոստիկանությունից գրավոր պարզաբանումներ կպահանջվեն առանձին վարույթով:
Մարդու իրավունքների պաշտպանը նաև անընդունելի է համարում նստացույց հայտարարած՝ ՀՀ Ազգային ժողովի մարդու իրավունքների և հանրային հարցերի մշտական հանձնաժողովի նախագահ Նաիրա Զոհրաբյանի և խորհրդարանի մի շարք այլ կին պատգամավորներին փողոցից հեռացնելու եղանակը:
