ԱՅՈ-ականների և ՈՉ-ականների հակամարտությունն օր օրի զարգանում է: Նախագծի հրապարակումից ի վեր չեն դադարում քննարկումները Սահմանադրության առաջարկվող տարբերակի առանձին կետերի վերաբերյալ: Բավականին լայն քննարկվում է նաև դատական իշխանության անկախության հարցը: 
Կարծիքներ են հնչում, որ ինչ էլ լինի, Սահմանադրությունն ինչպես էլ փոխեն, դատական համակարգը մշտապես լինելու է կախման մեջ իշխանություններից:

Մի քանի դիտարկումներ անենք. 
Սահմանադրության առաջարկվող նախագծի համաձայն՝ Արդարադատության խորհրդի փոխարեն ստեղծվելու է Բարձրագույն դատական խորհուրդ: Ի՞նչ է սա իրենից ներկայացնում: Այն անկախ պետական մարմին է, որը երաշխավորում է դատարանների և դատավորների անկախությունը: Այս մարմինն է նշանակելու դատարանների նախագահներին և դատավորներին: Բարձրագույն դատական խորհուրդը հնարավորություն կտա ապահովելու դատավորների արտաքին անկախությունը:
Բացի սա, Սահմանադրական դատարանի դատավորներն ընտրվելու են Ազգային Ժողովի կողմից՝ պատգամավորների ընդհանուր թվի ձայների առնվազն երեք հինգերորդով:
ՍԴ-ն էլ իր կազմից վեց տարի ժամկետով ընտրում է սահմանադրական դատարանի նախագահ և փոխնախագահ, որոնք վերընտրվելու իրավունք չունեն: Ինչ վերաբերվում է վճռաբեկ դատարանին, ապա այս կառույցում դատավորները նշանակվում են Հանրապետության նախագհի կողմից ԱԺ-ի առաջարկությամբ: Վճռաբեկ դատարանի նախագահին վեց տարի ժամկետով ընտրում է Ազգային ժողովը՝ Բարձրագույն դատական խորհրդի առաջարկությամբ:

Առաջարկվող նախագծով դատարանների նախագահները նշանակվելու են որոշակի ժամկետով, ինչը նպաստելու է դատավորների ներքին անկախության ապահովմանը:
