Աշխատանքի և սոցիալական հարցերի նախարարությունը հանրային քննարկման է ներկայացրել նախագծերի փաթեթ, որով առաջարկում է փոփոխություններ և լրացումներ կատարել «Կամավորական գործունեության և կամավոր աշխատանքի մասին» օրենքում:

Նշվում է, որ կամավորի իրավական կարգավիճակի օրենսդրական ամրագրման բացակայությունն էական խոչընդոտներ է առաջացնում կամավորներին անօրինական աշխատողներից տարանջատելու հարցում: 

Մեկ այլ խնդիր է, երբ կամավոր աշխատանքների կատարման համար օրենսդրորեն նախատեսված չեն լինում պայմանագրային կարգավորման վերաբերյալ պարտադիր պահանջներ, ինչն էլ պատճառ է դառնում, որ կամավորները զրկված լինեն որոշակի իրավական, սոցիալական և այլ երաշխիքներից: 

Օրենքի ընդունմամբ կամրագրվեն մի քանի սկզբունքներ, ինչպես օրինակ՝ 

1. կամավորական գործունեության և կամավոր աշխատանք կատարելու հետ կապված հարաբերություններն աշխատանքային հարաբերություններից, կամավոր աշխատանքն անօրինական կամ վարձու աշխատողի աշխատանքից տարանջատելու լիարժեք իրավական կարգավորումները, կամավոր աշխատանք կատարելու իրավասություն ունեցող անձանց շրջանակը, կամավորական գործունեության և կամավոր աշխատանքի սուբյեկտները,

2. կամավորի, կամավորական կազմակերպության միջև փոխհարաբերությունների պայմանագրային կարգավորումները, կամավոր աշխատանքի կատարման հետ կապված ծախսերի փոխհատուցման մեխանիզմները, կամավոր աշխատանքների կատարման հետ կապված ծախսերի փոխհատուցման մասով հարկային արտոնությունների սահմանումը, կամավոր աշխատանքի ընթացքում կամավորների և այլ անձանց առողջության և անվտանգության ապահովման երաշխիքները և այլն: 

Իհարկե, սրանք առաջարկվող բոլոր կարգավորումները չեն: Միևնույն ժամանակ նշվում է՝ կամավոր աշխատանք կատարող այլ անձի համար պայմանագրային կարգավորում օրենքի նախագծով չի նախատեսվել՝ վերջիններիս կամավոր աշխատանք կատարելու ինքնաբուխ ցանկությունները չսահմանափակելու և անհատական նախաձեռնությունները չխոչընդոտելու նպատակով: 

Օրենքի նախագծով նախատեսվել է՝ կամավորական գործունեություն կարող են իրականացնել և կամավորներ ներգրավել առևտրային կազմակերպությունները կամ անհատ ձեռնարկատերերը, սակայն բացառապես «Բարեգործության մասին» օրենքով սահմանված բարեգործական ծրագրին համապատասխան: Նախատեսվել է սահմանափակում, որի համաձայն՝ կամավորները չեն կարող ներգրավվել կամավորական կազմակերպությունների ձեռնարկատիրական գործունեության մեջ:
