Ենթադրվում է, որ մարդը կարող է ստե՞լ, տվյալներ չտրամադրե՞լ

Ազգային ժողովի այսօրվա արտահերթում նախարար Ռուստամ Բադասյանը ներկայացրեց մի նախագիծ, որը հասարակական լայն արձագանք գտավ, քանի որ առնչվում էր քաղաքացիների կատարած հեռախոսային զանգերին և, հետևաբար՝ անձնական կյանքին։
Նախարարի խոսքով՝ և՛ տեղորոշան, և՛ զանգերի կատարման տվյալները մի կենտրոնում գեներացնելը կնպաստի, որ այդ վիճակագրական տվյալների հիման վրա իրավասու մարմինները կարողանան միջոցառումներ ձեռնարկել և իրականցնել: Նույնիսկ ԱԺ նախագահը հարցի քննարկման ժամանակ կարծիք հայտնեց, որ այդ միջոցառումը կարող է ավելորդ լինի այս իրավիճակի համար: Այս միջոցառումը ոչ միայն հասկանալի չէ, ինչպես նկատում է Արարատ Միրզոյանը, այլև կարող է վատ նախադեպ դառնալ, և հետագայում կարող է վնասել պետությանը, ինչպես վնասել են, օրինակ՝ 2008-ից հետո արտակարգ դրության պայմաններում իրականացված մի շարք միջոցառումները, որոնք առնչվել են անձնական տվյալների պաշտպանության, մասնավոր և ընտանեկան կյանքի անձեռնմխելիության, հաղորդակցության ազատության և գաղտնիության իրավունքներին: Այս միջոցառումը համավարակի դեմ պայքարի շրջանակում քաղաքական հիմնավորում կունենար, եթե նշվեր, որ համավարակի դեմ պայքարում եղել են թերհաշվարկներ, կամ կան զարգացման այսինչ մտավախությունները, որոնց արդյունքում ծագել են կամ կարող են ծագել խնդիրներ, որոնք կարգավորելու համար կիրառվում է այս միջոցառումը։ Առանց քաղաքական գնահատականի այս միջոցառման արդյունավետությունը զրո է։ Օրինակ՝ Հնդկաստանի վարչապետը մի քանի օր առաջ ներողութուն խնդրեց ժողովրդից, որ պանդեմիայի դեմ պայքարում այս-այս հարցերում թերացել են, և խոստացավ՝ այսինչ-այսինչ քայլերով վերացնել սխալները։
Այս նախագիծն իմաստ կունենար այն ենթադրյալ դեպքում, եթե ՀՀ քաղաքացին վախենար իշխանությունների և հանրության պատժից, վախենար, որ տվյալներ տրամադրելով կարող է վնասել իր հետ կապ, կոնտակտ ունեցող մարդկանց։ Եթե տվյալներ տրամադրելու հետ կապված խնդիր կա, ապա իշխանությունները կարող են բացատրել մարդուն, որ այդ տվյալներն անհրաժեշտ են մարդկանց առողջության և կյանքի համար։
Արդյո՞ք կան այդպիսի պացիենտներ կամ մեկուսացվածներ, որոնք չեն տրամադրել պահանջվող տվյալները կամ չեն հասկացել այդ պահանջը։ Եթե կան, ապա նախագծի հիմնավորման մեջ հարկ է նշել, որ պայքարում բախվել են այդ խնդրին։ Իսկ եթե չկան, բայց ենթադրվում է, որ կլինեն մարդիկ, որոնք այս իրավիճակում կարող են ստել, տվյալներ չտրամադրել, գործել առողջության, կյանքի դեմ, ապա այդ ենթադրությունը ոչ միայն հակաքաղաքակրթական է, այլև վիրավորական քաղաքացու համար, որովհետև քաղաքակիրթ երկրում մարդու խոսքին վստահում են։
