ԱԺ արտահերթ նիստում քննարկվում է արտակարգ դրության ռեժիմը խախտողների համար պատիժ սահմանող փաթեթը (ուղիղ)
SOCIETYԱզգային ժողովը շարունակում է ուրբաթ երեկոյան մեկնարկած արտահերթ նիստը, որի օրակարգում մեկ հարց է՝ ՀՀ քրեական օրենսգրքում եւ Վարչական իրավախախտումների վերաբերյալ օրենսգրքում լրացումներ կատարելու մասին նախագծի փաթեթը։
Փաթեթն ուրբաթ ընդունվել է առաջին ընթերցմամբ, սակայն օրն ավարտվեց եւ հնարավոր չեղավ այն քննարկել երկրորդ ընթերցմամբ:
Ըստ էության, այս փոփոխություններով խստացումներ են մտցվում արտակարգ դրության ռեժիմը խախտողների համար:
Մասնավորապես, արդարադատության փոխնախարար Վահե Դանիելյանը ներկայացնելով փաթեթը, նշել է, որ արտակարգ դրության պայմաններում որոշ սահմանափակումների դեպքում ՀՀ օրենքներով նախատեսված չեն կոնկրետ իրավական հետեւանքներ։
Վարչական իրավախախտումների վերաբերյալ օրենսգրքում առաջարկվում է նոր մաս հետեւյալ բովանդակությամբ. «Արտակարգ իրավիճակի հիմքով հայտարարված արտակարգ դրության ժամանակ մեկուսացման կամ ինքնամեկուսացման պահանջները խախտելը, որի դեպքում սահմանվում է վարչական պատասխանատվություն՝ նվազագույն աշխատավարձի 300-500-ապատիկի չափով», ինչպես նաեւ ավելացվում է նոր մաս, հետեւյալ բովանդակությամբ. «ֆիզիկական եւ իրավաբանական անձանց կողմից արտակարգ դրության ժամանակ սահմանված տեղեկությունների հրապարակման կամ տարածման սահմանափակումները խախտել, որն առաջացնում է տուգանքի վճարում նվազագույն աշխատավարձի 50-300-ապատիկի չափով»:
Քրեական օրենսգիրքը լրացվում է 277.1 հոդվածով. «Արտակարգ իրավիճակի հիմքով արտակարգ դրության ժամանակ մեկուսացման կամ ինքնամեկուսացման պահանջները խախտելը, որն անզգուշությամբ առաջացրել է մարդկանց զանգվածային հիվանդացում, պատժվում է կալանքով մինչեւ 3 ամիս ժամկետով, կամ ազատազրկմամբ առավելագույնը 5 տարի ժամկետով»:
