Դատական կարգադրիչները զինվորական կենսաթոշակ չեն ստանա
SOCIETYԱշխատանքի և սոցիալական հարցերի նախարարությունն առաջարկում է փոփոխություն կատարել «Դատական դեպարտամենտում ծառայության մասին» ՀՀ օրենքում, մասնավորապես ուժը կորցրած ճանաչել օրենքի 75-րդ հոդվածը։
Նախագծի հիմնավորման մեջ նշվում է, որ դրա ընդունումը նպատակ ունի հստակեցնել զինվորական կենսաթոշակի իրավունք ունեցող անձանց շրջանակը:
Ներկայումս «Դատական դեպարտամենտում ծառայության մասին» ՀՀ օրենքի 75-րդ հոդվածի համաձայն` դատական կարգադրիչների ծառայությունից ազատվածների կենսաթոշակային ապահովության նկատմամբ կիրառվում են հարկադիր կատարողի համար օրենսդրությամբ սահմանված դրույթները:
«Պետական կենսաթոշակների մասին» ՀՀ օրենքի 17-րդ հոդվածի համաձայն` դատական ակտերի հարկադիր կատարողն ունի զինվորական կենսաթոշակի իրավունք: Վերը նշված իրավակարգավորումների արդյունքում դատական կարգադրիչներին վերապահվել է զինվորական կենսաթոշակի իրավունք՝ չնայած այն հանգամանքին, որ դատական կարգադրիչները չեն հանդիսանում զինծառայողներ կամ նրանց հավասարեցված անձինք, իսկ դատական կարգադրիչի պաշտոն զբաղեցնելու ժամանակահատվածը չի հաշվառվում զինվորական ծառայության ստաժում:
Նախագիծն ընդունվելու դեպքում դատական կարգադրիչների կենսաթոշակային ապահովությունը կիրականացվի ընդհանուր հիմունքներով, այսինքն՝ նրանց «Պետական կենսաթոշակների մասին» ՀՀ օրենքով սահմանված կարգով կնշանակվի աշխատանքային կենսաթոշակ:
Աշխատանքի և սոցիալական հարցերի նախարարությունը միևնույն ժամանակ տեղեկացնում է, որ այս նախագծի ընդունման դեպքում ՀՀ պետբյուջեում ծախսերի և եկամուտների էական ավելացում կամ նվազեցում չի նախատեսվում, ինչպես նաև դրա ընդունմամբ անհրաժեշտություն չկա իրավական այլ ակտերում ևս փոփոխություններ կատարելու: Օրենքն ուժի մեջ կմտնի պաշտոնական հրապարակման օրվան հաջորդող տասներորդ օրը:
