Արմեն Թավադյանն ազատ կարձակվի. Դատարանը բավարարել է պաշտպանների բողոքը

Վերաքննիչ քրեական դատարանը՝ դատավոր Ալեքսանդր Ազարյանի նախագահությամբ, բավարարեց Արմեն Թավադյանի կալանքի ժամկետը երկարացնելու որոշման դեմ պաշտպանների բողոքը։ Այս մասին «Փաստինֆո»-ին հայտնեց պաշտպան Հովհաննես Խուդոյանը։
Ավելի վաղ հայտնել ենք, որ փետրվարի 19-ին Երևանի ընդհանուր իրավասության դատարանը՝ դատավոր Մնացական Մարտիրոսյանի նախագահությամբ բավարարել է «5-րդ ալիք» ՀԸ սեփականատեր Արմեն Թավադյանի կալանքի ժամկետը ևս երկու ամսով երկարացնելու մասին ՀՔԾ քննիչի միջնորդությունը։ Պաշտպանները դատարանի այս որոշման դեմ բողոք է ներկայացրել եւ այն մակագրվել է Վերաքննիչ քրեական դատարանի դատավոր Ալեքսանդր Ազարյանին։
Նշենք, որ խափանման միջոցի վերաբերյալ առաջին դատական նիստը եղել է մարտի 5-ին, սակայն այս օրերին ՀՔԾ քննիչն ու դատախազը միմյանց հաջորդելով ինքնաբացարկի միջնորդություններ են ներկայացրել դատավոր Ալեքսանդր Ազարյանին, որոնք մերժվել են։
Արձանագրենք, որ Ալեքսանդր Ազարյանը համարվում է լավագույն դատավորներից մեկը։ 2020թ մարտի 10-ի դրությամբ նա ունի ամենաբարձր վարկանիշը՝ 46 միավորով։ Բացի այդ՝ նա երկու տարի շարունակ ճանաչվել է տարվա ամենաբարձր վարկանիշ ունեցող դատավոր։ Չնայած այդ հանգամանքին՝ դատավոր Ալեքսանդր Ազարյանի նկատմամբ աննախադեպ ճնշումներ են եղել 2018թ օգոստոսին կայացված դատական ակտից հետո, որով դատարանն արձանագրել էր, որ ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանն ունի գործառութային անձեռնմխելիություն, ինչը չի հաղթահարվել և վերացրել էր Ռոբերտ Քոչարյանի նկատմամբ ընտրված խափանման միջոցը՝ կալանավորումը։
Նշենք, որ Արմեն Թավադյանը մեղադրվում է «Մարտի 1»-ի գործով տուժողներից մեկին կաշառելու համար, դատարանում սուտ ցուցմունք տա։ Նրա դեմ ցուցմունք է տվել Ռ.Քոչարյանի մեկ այլ ենթադրյալ աջակից՝ Վ.Մկրտչյանը, որը նախ ձերբակալվել էր, ապա ազատ արձակվել։ Ընդ որում՝ վերջինիս եւս նույն հոդվածով՝ ՀՀ քրեական օրենսգրքի 340-րդ հոդվածի 4-րդ մասի 1-ին կետով, մեղադրանք է առաջադրվել, սակայն նրան կալանավորելու միջնորդություն ՀՔԾ քննիչը չի ներկայացրել։
Ա.Թավադյանը չի ընդունում առաջադրված մեղադրանքը, իսկ ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանի որդին՝ Լեւոն Քոչարյանը, հայտարարել է, որ տուժողներին կաշառելու անհրաժեշտություն չկա եւ չի եղել, քանի որ քրեական գործում չկա Ռ.Քոչարյանի դեմ որեւէ ցուցմունք, որը փոխելու կարիք լինի։
Փետրվարի 28-ին ՀՔԾ-ն հայտարարել է գործով նախաքննության ավարտի մասին։
