Օրենքով հստակեցվել է օտարերկրացիների աշխատանքի թույլտվության տրամադրումը

«Օտարերկրացիների մասին» ՀՀ օրենքում հստակեցվել են օտարերկրացիների աշխատանքի թույլտվության տրամադրման ընթացակարգը և վերացվել են այս առնչությամբ օրենքում տեղ գտած տարընթերցումները: «Նախկինում օտարերկրացիների մասին օրենքով ենթադրվող ենթաօրենսդրական կարգավորումներ չկային:Մի դեպքում՝ գործատուն պետք է դիմեր լիազորված մարմին օտարերկրացի աշխատողին աշխատանքի թույլտվության տրամադրման համար, մեկ այլ դեպքում` ինքը օտարերկրացին: Այժմ վե րը նշված օրենքի նոր կարգավորումներով միայնգործատունպետքէդիմի որոշակի լիազորված պետական կառավարման մարմին (որը դեռևս որոշված չէ)`օտարերկրացիներիհամար աշխատանքի թույլտվություն ստանալու նպատակով»,- այս մասին հայտնեցՀՀ աշխատանքի և սոցիալական հարցերի նախարարության աշխատանքի ևզբաղվածության վարչության պետԹադևոս Ավետիսյանը:
Նրա խոսքով՝ հստակեցվել են նաև գործատուի կողմից՝ ՀՀ օրինական մուտք գործած և աշխատանքի թույլտվություն ստացած օտարերկրացի աշխատողի և նրա ընտանիքի անդամների հետվերադարձի հետ կապված փոխհատուցման պայմանները: «Երբ գործատուն հրավիրում է օտարերկրացուն և հետագայում չի ապահովում խոստացված աշխատանքով, ապա նա պարտավոր է հոգալ տվյալ անձի և իր ընտանիքիկեցության,ինչպես նաև հետդարձիտոմսի ծախսերը»,- պարզաբանեց Ավետիսյանը:
Նա նշեց, որ «Օտարերկրացիների մասին» ՀՀ օրենքում հստակեցվել են նաև աշխատանքի թույլտվություն ստանալու բացառությունները: «Այդ բացառությունների մեջ ավելացել են բարձր որակավորում ունեցողօտարերկրացի մասնագետները, որոնքկարողենառանցթույլտվությանգալաշխատել Հայաստանում, ինչպես նաև Հայաստանի և այլ երկրների հետմիջազգային պայմանագրերով հաստատված դեպքերում»,- նկատեց Թադևոս Ավետիսյանը և հավելեց, որ վերը նշված օրենքի անցումային դրույթներով նախատեսված է դրույթ, որի համաձայն՝ մինչև օրենքի ուժի մեջ մտնելը ՀՀ-ում աշխատող, սակայն աշխատանքի թույլտվություն չունեցող օտարերկրացիների գործատուները 60 օրվա ընթացքում հաշվառման համար օտարերկրացիների հետ որոշակի ժամկետով կնքած աշխատանքային պայմանագրերի կրկնօրինակները պետք է ներկայացնեն լիազորված մարմին: «Մինչև օրենքի ուժի մեջ մտնելը օտարերկրացիների հետ կնքված աշխատանքային պայմանագրերի ժամկետը լրանալուց հետո գործատուները կարող են օտարերկրացի աշխատողի հետ աշխատանքային պայման ագիր կնքել՝ արդեն աշխատանքի թույլտվության հիման վրա, որի համար գործատուից նախատեսվում է գանձել 25 հազար ՀՀ դրամ»,- պարզաբանեց Ավետիսյանը:
Նա ընդգծեց նաև, որ հաշմանդամություն ունեցող անձանց աշխատանքի և զբաղվածության խթանման նպատակով պետական և ոչ պետական կազմակերպությունների համար դրված է պարտադիր նորմատիվ: «Ոչ պետական կազմակերպություններում հաշմանդամությունունեցողանձիք պետք է կազմեն ողջ աշխատողների թվի մեկտոկոսը, իսկպետականկազմակերպություններում՝ երեք տոկոսը (100-իցավելիաշխատողներունեցող կազմակերպությունում), որի չիրականացման դեպքում նախատեսվա ծ են օրենքով սահմանված տույժեր և տուգանքներ»,- հայտնեց բանախոսը:
