Քա­ղա­քա­ցի­ու­թյուն ստա­նա­լու դի­մում­նե­րի քննարկ­ման ժամ­կե­տը 6 ամս­վա փո­խա­րեն կսահ­ման­վի 3 ամիս

Արդարադատության նախարարությունը երեկ հանրային քննարկման է ներկայացրել «ՀՀ քաղաքացիության մասին» օրենքում փոփոխություններ և լրացումներ կատարելու մասին» օրենքի նախագիծը, որը մշակել է ոստիկանությունը։ 

Նշվում է, որ այս օրինագծի ընդունման դեպքում կապահովվի Սահմանադրությամբ ամրագրված՝ ազգությամբ հայերի պարզեցված կարգով ՀՀ քաղաքացիություն ստանալու իրավունքի լիարժեք իրացումը, ավելի կոնկրետ՝ ազգությամբ հայերի կողմից ՀՀ քաղաքացիություն ստանալու դիմումների քննարկման ժամկետը 6 ամսվա փոխարեն կսահմանվի 3 ամիս։ 

Բացի դա, օրենքի ներկայիս կարգավորումների համաձայն՝ ՀՀ քաղաքացիություն ձեռք բերած անձինք առաջին անգամ անձնագիր ստանում են Հայաստանում, բացառությամբ կառավարության որոշմամբ սահմանված որոշ պետությունների։ 

Նշվում է, որ ներկայումս ոստիկանության անձնագրային և վիզաների վարչությունում կան 20000-ից ավելի անձանց ՀՀ քաղաքացիություն շնորհելու վերաբերյալ նախագահի հրամանագրեր, սակայն տարբեր հանգամանքներով պայմանավորված այդ մարդիկ չեն կարողանում գալ Հայաստան՝ անձնագիրը ստանալու համար, ուստի առաջարկվում է լրացում կատարել օրենքում, որով ազգությամբ հայերը կկարողանան անձնագիրը ստանալ նաև օտարերկրյա պետություններում գործող ՀՀ դեսպանություններում և հյուպատոսական հիմնարկներում։ 

Հայաստանում դեռևս բնակվում են ազգությամբ հայեր կամ նախկին ԽՍՀՄ այլ հանրապետությունների քաղաքացիներ, որոնք չունեն որևէ երկրի քաղաքացիություն և դիմում են ոստիկանություն՝ մեր երկրի քաղաքացի ճանաչվելու և անձը հաստատող փաստաթղթով փաստաթղթավորվելու համար, ուստի առաջարկվում է նշված խմբի անձանց համար ՀՀ քաղաքացիություն ձեռք բերելու դիմում ներկայացնելու համար օրենքով սահմանված ժամկետը երկարաձգել մինչև 2023 թ.-ի դեկտեմբերի 31-ը։ 

Սահմանված են նաև որոշակի փոփոխություններ, որոնք վերաբերում են ՀՀ քաղաքացիությունը դադարեցնելու, փոփոխելու իրավակարգավորումներին, ՀՀ-ում ապաքաղաքացիության կրճատմանը։ 

Նշվում է՝ լինում են դեպքեր, երբ ՀՀ քաղաքացիները դիմում են քաղաքացիությունը դադարեցնելու համար՝ ներկայացնելով օտարերկրյա պետության իրավասու մարմնի կողմից տրված գրավոր հավաստումը տվյալ պետության քաղաքացիություն ձեռք բերելու հնարավորության մասին, սակայն հետագայում տարբեր պատճառներով ձեռք չեն բերում տվյալ պետության քաղաքացիությունը՝ փաստացի հայտնվելով քաղաքացիություն չունեցող անձի կարգավիճակում: 

Հետո հարկադրված դիմում են անձնագրային և վիզաների վարչություն՝ քաղաքացիություն չունեցող անձի վկայականով փաստաթղթավորվելու համար՝ հիմնարար իրավունքներ ձեռք բերելու նպատակով։ 

Այս և այլ հանգամանքներով պայմանավորված՝ վերջին տարիներին ՀՀ-ում կտրուկ աճել է քաղաքացիություն չունեցող անձանց թիվը։ Ներկայումս այն գերազանցում է 900-ը։
