Վայոց Ձորի մարզի Գնդեվազ համայնքի նախկին ղեկավարի կողմից առերևույթ կատարված չարաշահումների դեպքի առթիվ 2019 թվականի հուլիսին հարուցվել էր քրեական գործ, որի նախաքննությունն իրականացվել է ՀՀ քննչական կոմիտեի ՀԿԳ քննության գլխավոր վարչությունում: Այս մասին հայտնում են ՀՀ քննչական կոմիտեից:

 

Քրեական գործով կատարված մեծածավալ քննչական և դատավարական այլ գործողությունների արդյունքում պարզվել է, որ Գնդեվազ համայնքի նախկին ղեկավարը, 2012թ. սեպտեմբերից մինչև 2016թ. հոկտեմբերն ընկած ժամանակահատվածում զբաղեցնելով նշված պաշտոնը, տեղյակ լինելով, որ ՓԲ ընկերությունը նշված համայնքում պատրաստվում է հողատարածքներ ձեռք բերել և պատրաստ է բարձր գին վճարել դրանց դիմաց, շահադիտական դրդումներից ելնելով, մտադրվել է ձևական աճուրդի միջոցով որդու անվամբ այդ վայրում գտնվող՝ համայնքային սեփականություն հանդիսացող հողատարածք ձեռք բերել, այնուհետև վաճառել այն ընկերությանը՝ անհամեմատ բարձր գնով։

 

Մասնավորապես՝ նշված համայնքի նախկին ղեկավարը, 2014թ. մարտի 27-ին հրավիրված ավագանու նիստի ժամանակ ստանալով հողատարածքն օտարելու վերաբերյալ ավագանու համաձայնությունը, որոշում է կայացրել աճուրդի միջոցով օտարել այն և աճուրդի մասնակից է գրանցել 18 տարին չլրացած՝ քաղաքացիական գործունակությամբ չօժտված իր որդուն: Վերջինս, 2014թ. մայիսի 6-ին տեղի ունեցած աճուրդի արդյունքում հաղթող ճանաչվելով, նշված հողատարածքը 410.130 ՀՀ դրամով ձեռք բերելու իրավունք է ստացել և գնել այն: Այնուհետև՝ 2015 թվականի մայիսի 26-ին, նույն հողատարածքը անհամեմատ բարձր գնով՝ 147.300.838 ՀՀ դրամով, վաճառել է ՓԲ ընկերությանը՝ այս կերպ օժանդակելով հոր գործողություններին, որի արդյունքում Գնդեվազ համայնքին պատճառվել է 146.890.708 ՀՀ դրամի գույքային վնաս:

 

Ձեռք բերված բավարար ապացույցների հիման վրա՝ Գնդեվազ համայնքի նախկին ղեկավարին մեղադրանք է առաջադրվել՝ ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի (պաշտոնեական լիազորությունները չարաշահելը) 2-րդ մասով, իսկ որդուն՝ ՀՀ քրեական օրենսգրքի 38-308-րդ հոդվածի (պաշտոնեական լիազորությունները չարաշահելուն օժանդակելը) 2-րդ մասով:

 

Նախաքննության ընթացքում Գնդեվազ համայնքի նախկին ղեկավարի կողմից որպես հանցագործությամբ պատճառված վնասի վերականգնում ՀՀ ՔԿ դեպոզիտ հաշվին է փոխանցվել ընդհանուր 70.000.000 ՀՀ դրամ գումար: Բացի այդ, որոշում է կայացվել վերջինիս գույքի վրա կալանք դնելու մասին:

 

Նախաքննությունն ավարտվել է, և քրեական գործը՝ մեղադրական եզրակացությամբ, ուղարկվել նախաքննության օրինականության նկատմամբ հսկողություն իրականացնող դատախազին:

 

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
