BLOG«Հայաստանի հելսինկյան կոմիտե» ՀԿ նախագահ, իրավապաշտպան Ավետիք Իշխանյանը՝ անդրադառնալով սահմանադրական փոփոխությունների հանրաքվեին: Նա մասնավորապես նշել է, որ հանրաքվեի դրված հարցը զուտ քաղաքական է և որևէ կապ չունի իրավունքի և օրենքի հետ: Գրառումն ամբողջությամբ՝ ստորև.
«Նորից հանրաքվեի մասին
Այն որ հանրաքվեի դրված հարցը զուտ քաղաքական է և որևէ կապ չունի իրավունքի և օրենքի հետ, կարծում եմ պարզ է բոլորին։ Եվ այն, որ հարցը միայն ՍԴ-ի Սիրելի Առաջնորդին չենթարկվելն է, նույնպես պարզ է։ Սա արդեն չեն թաքցնում նույնիսկ իմքայլականները. «Հրայր Թովմասյանը չի ընդունել խաղի կանոնները, իսկ Արթուր Դավթյանն ու Տիգրան Մուկուչյանը չեն առճակատվել»։ Այսինքն «ժողովուրդ, ժողովրդի կամք և այլն» խոսքերը, ներեցեք, ոչ թե, մեղմ ասած, մանկամտություն է, այլ նույն ժողովրդի «ժողովրդավարություն» հասկացողության չիմացության շահարկում։ Նրանց դիրքորոշումը պարզ է՝ ամեն գնով ամրապնդել Սիրելի Առաջնորդի մենիշխանությունը և վայելել իրենց բաժին արտոնությունները։
Այժմ, խոսքս ուղղում եմ նախորդ իշխանություններին ատող, նորերին երկրպագող, կամ ընդունող, իրենց անկախ, անկողմնակալ համարող հասարակական գործիչներին․
Ձեր փաստարկներից հիմնականը ոչ թե հանրաքվեի օրենքի սահմանադրական լինել կամ չլինելն է, այլ որ գործող սահմանադրության հանրաքվեն կեղծվել է։ Բայց, հարգելիներս, կեղծվել են 1995, 2005թթ․ սահմանադրական հանրաքվեները ևս։ Ոստի, ի՞նչ եք առաջարկում, չեղարկել անկախության տարիների բոլոր սահմանադրական նորմերը, օրենքները, պետական կառույցները և վերադառնալ Հայկական ԽՍՀ սահմանադրությա՞նը, թե՞ զրոից սկսել, բայց ո՞ր զրոից։ Եվ եթե դուք իրավական պետության կողմնակից եք, ապա կարծում եմ, որպես հենման կետ, պետք է ամեն դեպքում գործել, թեկուզ ձեր կողմից չընդունվող, բայց գործող սահմանադրության դրույթներով։
Իսկ եթե, «այսօր օրենքների մասին խոսելու ժամանակը չի» և պետք է հեղափոխական ճանապարհով հարցերը լուծել, ապա ինչո՞ւ Սիրելի Առաջնորդից չեք պահանջում հրաժարվել, նույն կեղծված սահմանադրությամբ և օրենքներով նախատեսված այլ պետական կառույցներից, կառավարական առանձնատներից, այլ արտոնություններից, սուպերվարչապետությունից և այլն։ Չէ՞, որ Սիրելի Առաջնորդն այդ ամենը բացատրում է գործող օրենքներով և կարծես ձեր կողմից բողոքներ չեն լսվում։ Իսկ եթե հարցը վերաբերում է միայն ՍԴ նախագահ Հրայր Թովմասյանի «նախկին» լինելուն, տես վերը բերված իմքայլականի անկեղծ տեսակետը:
