Վենետիկի հանձնաժողովի կարծիքի անհրաժեշտությունն ու շահարկման պրակտիկան

«Մենք աշակերտներ ենք Եվրոպայի առաջ և մեր ապագան կախված է նրանից, թե որքան լավ աշակերտներ ենք լինելու մենք: Այնտեղ համամարդկայինը միացած է ազգայինի հետ, այնտեղ առաջ Մարդն է, հետո հագուստը, իսկ մեզանում առաջ հագուստն է, հետո մարդը, իսկ երբեմն` միայն հագուստն է, իսկ մարդը չկա»: -Վահան Տերյան, Հայ գրականության գալիք օրը, 1914թ։

2000-ից ի վեր եվրաինտեգրացիոն բարեփոխումների նպատակն է Հայաստանը արժեքաբանական առումով Եվրոպային մոտեցնելը։ Եվրոպան ձգտում է Հայաստանում տարածել եվրոպական արժեքներ, իսկ Հայաստանը պարտավորվել է՝ պահպանել դրանք հիմնարար փաստաթղթերում և չշեղվել ժողովրդավարությունից։ Այս տրամաբանության մեջ է տեղավորվում նաև այն պարտավորությունը, որ ՀՀ հիմնարար օրենսդրության փոփոխության հարցում ուղենշային է Վենետիկ հանձնաժողովի կարծիքը։

Չնայած այս պարզ տրամաբանությանը, Վենետիկի հանձնաժողովին դիմելու պրակտիկան քաղաքական շահարկման է ենթարկվել նախկինում ընդդիմադիր ուժերի, այդ թվում՝ երբեմնի ընդդիմադիր գործիչ Նիկոլ Փաշինյանի կողմից։ Ընդդիմադիրն անուղղակի հանդիմանում էր Վենետիկի հանձնաժողովին՝ ժողովրդականություն չունեցող իշխանություններին աջակցելու համար։ Այսպիսին էին ընդդիմադիր ուժերի գնահատականները նաև նախորդ՝ 2015-ի Սահմանդրական փոփոխությունների նախաձեռնման փուլում։

Եվ քանի որ՝ Թավշյա, ոչ բռնի, ժողովրդական հեղափոխությունը ՀՀ արտաքին քաղաքական առաջնահերթություններում ոչինչ չի փոխել, ապա բնական է, որ «Իմ քայլի» նախաձեռնության վերաբերյալ մերօրյա ընդդիմության թիրախները, պահանջն ու հանդիմանանքը նույնը պիտի լինեին, այդ թվում նաև Վենետիկի հանձնաժողովին դիմել-չդիմելու ժամանակի և նրանից ակնկալով արձագանքի առնչությամբ։ Եվ դա օրինաչափ է նաև այն առումով, որ նախկին ու ներկա ընդդիմադիրները, և ընդհանրապես, քաղաքական համայնքը օբյեկտիվորեն կարևորում են Վենետիկի հանձնաժողվի կարծիքը, քանի որ այն ՀՀ իշխանությունների նախաձեռնությանը լեգիտիմություն է հաղորդում համապատասխան գնահատականներով։

Ուշագրավ է, որ 2019-ի հուլիսին Վենետիկի հանձնաժողովի արած հայտարարության մեջ նշված է. «Վենետիկի հանձնաժողովը բեղմնավոր է գնահատում Հայաստանի իշխանությունների հետ աշխատանքը և դատական բարեփոխումների առնչությամբ կարծիք կներկայացնի, երբ պատրաստ կլինեն ՀՀ դատական օրենսգրքի փոփոխությունները»: Եթե նկատի ունենանք, որ այս հայտարարության ժամանակ ՍԴ-ն արդեն խորը ճգնաժամի մեջ էր, ապա կարելի է ակնկալել, որ «Հայաստանի Հանրապետության Սահմանադրության փոփոխությունների նախագիծը հանրաքվեի դնելու մասին» ԱԺ որոշման վերաբերյալ Վենետիկի հանձնաժողովի կարծիքը պարունակելու է բովանդակային քննադատություն որոշ նորմերի հնարավոր խախտումների վերաբերյալ, ինչպես եղել է նախկին փոփոխությունների ժամանակ։
