Ժամկետային զինծառայողը կացինով ու քլունգով կրտսեր սերժանտին սպանելու սպառնալիքներ է հնչեցրել․ երկուսին էլ մեղադրանք է առաջադրվել, գործը դատարանում է։ Այս մասին NEWS.am-ը տեղեկանում է դատական-տեղեկատվական համակարգից։

 

Ն․ Ե․-ն հանդիսանալով պարտադիր ժամկետային զինծառայող, կոչումով շարքային, ընդգրկված լինելով մարտական հերթապահության մեջ, որպես դիտորդ, զինվորական ծառայության պարտականությունները կատարելու հետ չկապված՝ իր նկատմամբ պետ հանդիսացող՝ դիրքի ավագ՝ պարտադիր ժամկետային զինծառայող, կրտսեր սերժանտ Գ․ Զ․- ի կողմից դիրքի ստուգման մատյանը դրսից գետնատնակ տանելու իրեն տրված հանձնարարությունը չկատարելու եւ դրա հետեւանքով մատյանն անձրեւից թրջվելու պատճառով առաջացած վիճաբանության ընթացքում իրեն հարվածելու համար, սեռական բնույթի հայհոյանքներ հնչեցնելով, բռնություն գործադրելու դիտավորությամբ՝ որպես զենք օգտագործվող կացինը նետել է կրտսեր սերժանտ Գ.Զոհրաբյանի ուղղությամբ, սակայն վերջինս թաքնվել է դիտակետում եւ կացինը նրան չի դիպչել: Այնուհետեւ՝ շարունակելով իր հանցավոր գործողությունները, սեռական բնույթի հայհոյանքներ հնչեցնելով վերցրել է քլունգը եւ գնացել Գ.Զ․-ի ուղղությամբ՝ միաժամանակ քլունգով հարվածելու եւ սպանելու սպառնալիքներ հնչեցրել նրա հասցեին, սակայն համածառայակիցները բռնել են նրան եւ քլունգը վերցրել ձեռքից՝ այդպիսով հանցագործությունն ավարտին չի հասցրել իր կամքից անկախ հանգամանքներում:

 

Գ․ Ժ․-ն հանդիսանալով պարտադիր ժամկետային զինծառայող, կոչումով կրտսեր սերժանտ, ընդգրկված լինելով մարտական հերթապահության մեջ, որպես դիրքի ավագ, զինվորական ծառայության պարտականությունները կատարելու հետ կապված՝ դիրքի ստուգման մատյանը դրսից գետնատնակ բերելու իր հանձնարարությունը շարքային Ն.Ե․-ի կողմից չկատարելու եւ այդ կապակցությամբ մատյանը անձրեւից թրջվելու պատճառով, ծեծի է ենթարկել իր նկատմամբ ստորադաս հանդիսացող՝ պարտադիր ժամկետային զինծառայող, շարքային Ն.Ենգիբարյանին՝ պատճառելով առողջության թեթեւ վնասի հատկանիշներ պարունակող մարմնական վնասվածքներ:

 

Գ․ Ժ․-ին մեղադրանք է առաջադրվել ՔՕ 358․1-րդ հոդվածի 3-րդ մասի 4-րդ կետով (Ստորադասի նկատմամբ բռնի գործողություններ կատարելը կամ դրանք կատարելու սպառնալիք, առողջությանը թեթեւ կամ միջին ծանրության վնաս պատճառելով)։

 

Ն․ Ե․-ին մեղադրանք է առաջադրվել ՔՕ 358-րդ հոդվածի 3-րդ մասի 2-րդ կետով (Զինվորական ծառայության պարտականությունները կատարելու կապակցությամբ պետին (հրամանատարին) ծեծելը կամ նրա նկատմամբ այլ բռնություն գործադրելը կամ դա գործադրելու սպառնալիքը պետի (հրամանատարի) կամ նրա մերձավորի նկատմամբ):

 

Գործը մակագրվել է Սյունիքի մարզի ընդհանուր իրավասության դատարանի դատավոր Հրաչյա Մեխակյանին։
