Առաջին ընթերցմամբ չենք ընդունելու Սահմանադրական այս փոփոխությունը եւ այն դրվելու է հանրաքվեի. Վահագն Հովակիմյան
VIDEOԱյսօր Սահմանադրությունը նախատեսում է, որ Սահմանադրական փոփոխությունները ԱԺ-ի կողմից չընդունվելու դեպքում խորհրդարանը կարող է 3/5-ով որոշել հարցը դնել հանրաքվե։ Այս մասին այսօր՝ փետրվարի 6-ին, ԱԺ-ում լրագրողների հետ զրույցում նշեց «Իմ քայլը» խմբակցության պատգամավոր Վահագն Հովակիմյանը անդրադառնալով Սահմանադրական փոփոխությունների նախագծին, որը նախատեսում է, որ 2018-ի ապրիլից առաջ ընտրված ՍԴ անդամների լիազորությունները դադարեցվում են:
« Խորհրդարան՝ սահմանադրական դատարան դիմելու ընթացակարգը սահմանված է ԱԺ կանոնակարգ օրենքով, որը վերաբերում է 2-րդ ընթերցումից առաջ, իսկ առաջին ընթերցմամբ չընդունվելու դեպքում կանոնակարգ օրենքը որեւէ հիշատակում չի անում։ Առաջին ընթերցմամբ չընդունվելը ԱԺ կանոնակարգ օրենքով կարգավորված չէ, այդ թվում կարգավորված չէ, թե առաջին ընթերցումից առաջ արդյոք պետք է խորհրդարանը դիմի ՍԴ, բայց միանշանակ ամրագրված է, որ Սահմանադրության 202-րդ հոդվածի երրորդ կետի ուժով, եթե չի ընդունվում սահմանադրական փոփոխությունը խորհրդարանը կարող է 3/5-րդով որոշում կայացնել եւ դիմել հանրաքվեի»,-ասաց նա:
Դիտարկմանը, որ Սահմանադրության 168-րդ հոդվածը նախատեսում է, որ ՍԴ-ն մինչեւ Սահմանադրության փոփոխությունների նախագծի ընդունումը որոշում է դրանց համապատասխանությունը Սահմանադրությանը, Վահագն Հովակիմյանն ասաց. «168-րդ հոդվածը սահմանում է ՍԴ-ի լիազորությունները: Լիազորություն ունենալն ինքնին չի ենթադրում պարտադրություն: Մենք ունենք մի իրավիճակ, երբ ԱԺ կանոնակարգը կարգավորում է երկրորդ ընթերցման փուլը, չի կարգավորում առաջին փուլը. Եւ մենք ունենք 202-րդ հոդվածի 3-րդ կետ, որն ԱԺ-ին տալիս է լիազորություն: Այսինքն ԱԺ լիազորությունը չի կարող ստորադասվել խնդրի չկարգավորված չլինելուն: Այսինքն այն հանգամանքը, որ խնդիրն այս պահին բաց է թողնված, չի կարող հիմք հանդիսանալԱԺ լիազորությունը սահմանափակելու համար»:
Նա պարզաբանեց իրենց ընտրած մարտավարությունը. «Իմ քայլը» խմբակցությունն առաջին ընթերցմամբ չի ընդունելու Սահմանադրական այս փոփոխությունը եւ օգտվելով Սահմանադրության 202-րդ հոդվածի երրորդ կետով իրեն տրված լիազորությունից, եւ Սահմանադրության անփոփոխելի երկրորդ հոդվածի ուժով, հարցը ներկայացվելու է հանրաքվեի: Իսկ հանրաքվեից ավելի ժողովրդավարական ու իրավական մեթոդ աշխարհը դեռ չի հնարել»:
