Նախագիծ՝ մայրության նպաստի, ժամանակավոր անաշխատունակության մասին և ոչ միայն

Աշխատանքի և սոցիալական հարցերի նախարարությունը հանրային քննարկման է ներկայացրել նախագիծ, որով առաջարկում է փոփոխություններ և լրացումներ կատարել կառավարության 2011 թ. հուլիսի 14-ի N 1024-Ն որոշման մեջ։ 

Նախագծի ընդունումը պայմանավորված է ««Ժամանակավոր անաշխատունակության և մայրության նպաստների մասին» ՀՀ օրենքում փոփոխություններ և լրացումներ կատարելու մասին» 2019 թ.-ի հունիսի 6-ի ՀՕ-78-Ն օրենքի ընդունմամբ: Ներկայացվող նախագծով վերը նշված օրենքին համապատասխան հստակեցվել է, որ. 

1.վարձու աշխատողը, որ միաժամանակ ինքնուրույնաբար իրեն աշխատանքով ապահոված անձ է` վերը նշված օրենքի 4-րդ հոդվածի 3.1-ին մասի 2-րդ և 3-րդ կետերում նշված դեպքերում մայրության նպաստը հաշվարկելու, նշանակելու և վճարելու համար հիմնական աշխատավայրի գործատուին ներկայացնում է նաև ժամանակավոր անաշխատունակությունը ծագելու տարվան նախորդող տարվա ընթացքում բացառապես միկրոձեռնարկատիրության սուբյեկտ, իսկ մինչև 2020 թվականի հունվարի 1-ը` ընտանեկան ձեռնարկատիրության սուբյեկտ համարվելու կամ «Ինքնազբաղված անձանց հարկային արտոնությունների մասին» օրենքով սահմանված հարկային արտոնություններից օգտվելու ժամանակահատվածների վերաբերյալ տեղեկանքը, 

2.օրենքի 4-րդ հոդվածի 3.1-ին մասի 2-րդ և 3-րդ կետերում նշված դեպքերում ինքնուրույնաբար իրեն աշխատանքով ապահոված անձն իրեն տրվող մայրության նպաստը նշանակելու և վճարելու համար իր պետական գրանցման վայրի տարածքային բաժին է ներկայացնում նաև ժամանակավոր անաշխատունակությունը ծագելու տարվան նախորդող տարվա ընթացքում բացառապես միկրոձեռնարկատիրության սուբյեկտ, իսկ մինչև 2020 թվականի հունվարի 1-ը` ընտանեկան ձեռնարկատիրության սուբյեկտ համարվելու կամ «Ինքնազբաղված անձանց հարկային արտոնությունների մասին» օրենքով սահմանված հարկային արտոնություններից օգտվելու ժամանակահատվածի մասին տեղեկանքը, 

3. եթե ինքնուրույնաբար իրեն աշխատանքով ապահոված անձը ժամանակավոր անաշխատունակությունն առաջանալու տարվան նախորդող տարում իրականացրել է հարկման հատուկ համակարգերով հարկվող գործունեության մեկից ավելի տեսակներ, ապա մայրության նպաստը հաշվարկելիս` միջին ամսական եկամտի հաշվարկում ժամանակավոր անաշխատունակության դեպքի տարվան նախորդող տարվա` նշված գործունեություն(ներ) իրականացրած յուրաքանչյուր ամսվա համար ընդունվում է ժամանակավոր անաշխատունակությունն առաջանալու օրվա դրությամբ սահմանված նվազագույն ամսական աշխատավարձի հիսուն տոկոսը` անկախ տվյալ ամսում իրականացրած գործունեության տեսակների քանակից:
