ՀՀ ազգային անվտանգության ծառայությունը, հետևողական և անզիջում պայքար մղելով կոռուպցիայի տարաբնույթ դրսևորումների դեմ, օրենքով իրեն վերապահված գործառույթների շրջանակներում ձեռնարկված օպերատիվ-հետախուզական միջոցառումների և քննչական գործողությունների արդյունքում ստացել է փաստական տվյալներ, որ ՀՀ ոստիկանության Կոտայքի մարզային վարչության Գառնիի բաժանմունքի նախկին պետը, իր պաշտոնավարման ընթացքում հանդիսանալով իշխանության ներկայացուցչի գործառույթներով օժտված պաշտոնատար անձ և հետաքննության մարմնի ղեկավար, պաշտոնեական լիազորությունները չկատարելով և այն ծառայության շահերին հակառակ օգտագործելով, միջոցներ չի ձեռնարկել իր ծանոթների կողմից կազմակերպված՝ Ձորաղբյուր համայնքի հին գերեզմանատանը տարածքներ հատկացնելու պատրվակով քաղաքացիներից խարդախությամբ առանձնապես խոշոր չափերով գումարներ հափշտակելու դեպքերի կապակցությամբ հանցագործությունը բացահայտելու ուղղությամբ։ Այս մասին տեղեկացնում է ԱԱԾ-ն:

 

Մասնավորապես Ձորաղբյուր համայնքի բնակիչներից մեկի հաղորդման հիման վրա՝ վերջինիս հոր գերեզմանում այլ հուղարկավորություն կատարելու դեպքի առթիվ նախապատրաստվող նյութերով, հիշյալ պաշտոնատար անձը ակնհայտ ապօրինի գործողություններ կատարելու համար 2019 թ. փետրվարին որպես կաշառք ստանալով զգալի չափով կանխիկ գումար, հետաքննություն իրականացնող անձին ցուցում է տվել շեղել քննության ընթացքը, անտեսել և թաքցնել գործի համար կարևոր նշանակություն ունեցող ապացույցներն ու հանգամանքները: Հետաքննություն իրականացնող անձը բաժանմունքի պետի հանձարարությամբ խեղաթյուրել է մի շարք քաղաքացիներից վերցված բացատրությունների բովանդակությունը և, համապատասխան հիմքեր ստեղծելով, որոշում է կայացրել հանցակազմի բացակայության հիմքով քրեական գործի հարուցումը մերժելու մասին։ Արդյունքում՝ ծանր հետևանքներ են հասցվել արդարադատության ոլորտում պետության օրինական շահերին, պայմաններ են ստեղծվել առերևույթ ծանր հանցագործություն ենթադրաբար կատարած անձին պատշաճ քրեական պատասխանատվությունից ազատելու համար, խաթարվել է արդարադատության բուն էությունը և վստահությունը պետական իշխանության նկատմամբ:

 

ՀՀ ԱԱԾ քննչական դեպարտամենտում առերևույթ հանցագործության դեպքի առթիվ քննվող քրեական գործի շրջանակներում, հիշյալ 2 պաշտոնատար անձանց մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի համապատասխան հոդվածով, նրանցից մեկը տվել է խոստովանական բնույթի ցուցմուքներ և պնդել դրանք առերեսման ժամանակ։ Երկուսի նկատմամբ ընտրվել է խափանման միջոց, նախաքննությունը շարունակվում է։
