Փետրվարի 6-ին արտահերթ նիստ գումարելու մասին Արարատ Միրզոյանի որոշումը անվավեր է ճանաչվել
POLITICSԱզգային ժողովի նախագահի Արարատ Միրզոյանի որոշմամբ իր՝ 2020 թվականի հունվարի 30-ի «Հայաստանի Հանրապետության Ազգային ժողովի արտահերթ նիստ գումարելու մասին» ՆՈ-16-Լ որոշումը ճանաչվել է անվավեր։ Այս մասին հայտնում են ԱԺ-ից։
««Հիմք ընդունելով «Ազգային ժողովի կանոնակարգ» սահմանադրական օրենքի 41-րդ հոդվածի 8-րդ մասի 1-ին կետը, ինչպես նաեւ «Նորմատիվ իրավական ակտերի մասին» օրենքի 38-րդ հոդվածի 1-ին մասը՝ ՈՐՈՇՈՒՄ ԵՄ.
1. Ազգային ժողովի նախագահի 2020 թվականի հունվարի 30-ի «Հայաստանի Հանրապետության Ազգային ժողովի արտահերթ նիստ գումարելու մասին» ՆՈ-16-Լ որոշումը ճանաչել անվավեր:
2. Առաջարկել 2020 թվականի փետրվարի 6-ին Ազգային ժողովի արտահերթ նիստ գումարելու նախաձեռնությունը պաշտոնապես ներկայացրած Ազգային ժողովի պատգամավորների՝ արտահերթ նիստ գումարելու վերաբերյալ գրությունը, ինչպես նաեւ դրան կից ներկայացվող փաստաթղթերը երեք աշխատանքային օրվա ընթացքում համապատասխանեցնել «Ազգային ժողովի կանոնակարգ» սահմանադրական օրենքի 41-րդ հոդվածի 3-րդ, 4-րդ, 5-րդ մասերի եւ 7-րդ մասի 2-րդ կետի պահանջներին»,- նշված է ԱԺ նախագահի՝ հունվարի 31-ին ստորագրած որոշման մեջ»,- նշված է հայտարարության մեջ:
Հիշեցնենք, որ երեկ ԱԺ կայքում տեղեկություն էր հրապարակվել, ըստ որի՝ փետրվարի 6-ին ԱԺ-ն արտահերթ նիստ կգումարի: Ըստ այդ տեղեկության՝արտահերթ նիստի օրակարգը հետևյալ հարցերի շուրջ էր՝ «Ազգային ժողովի կանոնակարգ» ՀՀ սահմանադրական օրենքում փոփոխություններ և լրացումներ կատարելու մասին», «Հանրաքվեի մասին» ՀՀ սահմանադրական օրենքում փոփոխություններ և լրացումներ կատարելու մասին» և «Սահմանադրական դատարանի մասին» ՀՀ սահմանադրական օրենքում լրացումներ և փոփոխություններ կատարելու մասին» օրենքների նախագծերի փաթեթը առաջին և երկրորդ ընթերցմամբ քննարկելը:
Նշենք, որ սահմանադրագետ, արդարադատության նախկին նախարար Գևորգ Դանիելյանն էլ իր ֆեյսբուքյան էջում գրել է, որ «Ազգային ժողով կանոնակարգ» սահմանադրական օրենքում փոփոխություններ և լրացումներ կատարելու նախաձեռնությունը՝ կապված Սահմանադրության փոփոխությունների համատեքստում Հանրապետության նախագահի և Սահմանադրական դատարանի լիազորությունների սահմանափակման հետ, հիմնազուրկ է, այն լրջագույն աղերսներ ունի Սահմանադրության հետ։ «Հիմնավորման մեջ, առնվազն համարժեք չեն ընկալվել և մեկնաբանվել Սահմանադրության հիմնադրույթները, առկա է ակնհայտ շփոթ»,- գրել է նա։
ԱԺ «Լուսավոր Հայաստան» խմբակցության ղեկավար Էդմոն Մարուքյանը ևս անդրադարձել է փետրվարի 6-ին նախատեսվող ԱԺ արտահերթ նիստի օրակարգին: Նա մասնավորապես նշել է, որ նման հիմնարար փոփոխությունները չպետք է կատարվեն արտահերթ ընթացակարգով:
