«Sut nikol» գործով «Իրավական ուղի» ՀԿ-ն դատարանում հաղթանակ գրանցեց

Տեղեկացնում ենք, որ 2019 թվականի ապրիլի 15-ին՝ առավոտյան ժամը 6․30-ի սահմաններում, մի խումբ քաղաքացիներ իրականացրել են քաղաքական ակցիա՝ Երևան քաղաքի փողոցների տարբեր հատվածներում «Sut nikol» գրառումներ կատարելով։ Քաղաքական ակցիայի նպատակը քաղաքացիների իրազեկումն էր առ այն, որ իշխանությունը կրող քաղաքական ուժը նախընտրական շրջանում տվել է քաղաքական սուտ խոստումներ։

ՀՀ ոստիկանության ծառայողների կողմից քաղաքական ակցիայի իրականացումը կանխվել է․ մասնակիցները բերման են ենթարկվել ՀՀ ոստիկանության Երևան քաղաքի վարչության կենտրոնական բաժին, որտեղ պահվել են 3 ժամ։ Արդյունքում ակցիայի մասնակիցների նկատմամբ կայացվել է Վարչական իրավախախտումների վերաբերյալ ՀՀ օրենսգրքի 172․2-րդ հոդվածով վարչական պատասխանատվության ենթարկելու որոշում՝ 20 000 ՀՀ դրամ տուգանքի չափով։

 

«Իրավական ուղի» իրավապաշտպան ՀԿ-ի կողմից կատարված ուսումնասիրությունների արդյունքում պարզվել է, որ 2018 թվականին տեղի ունեցած իշխանափոխությունից առաջ ևս քաղաքացիների կողմից փողոցում և այլ հասարակական վայրերում բազմիցս կատարվել են գրառումներ, այդ թվում՝ քաղաքական քննադատական բնույթի, սակայն տվյալներ առկա չեն եղել, որ նման գործողությունների նկատմամբ կիրառված լիներ վարչական միջամտություն։

 

Մասնավորապես պարզվել է, որ 2017-2019 թթ․ ընթացքում Վարչական իրավախախտումների վերաբերյալ ՀՀ օրենսգրքի 172․2-րդ հոդվածը կիրառվել է միայն 2018 թվականի երկրորդ կեսին հինգ անձի նկատմամբ։ Այսինքն՝ Վարչական իրավախախտումների վերաբերյալ ՀՀ օրենսգրքի 172․2-րդ հոդվածը Հայաստանի Հանրապետությունում սկսել է կիրառվել միայն 2018 թվականի իշխանափոխությունից հետո։ Մինչ այդ նման ակցիաները պետության կողմից հանդուրժվել են։

 

2019 թվականի հուլիսի 12-ին ՀՀ ոստիկանության Երևան քաղաքի վարչության կենտրոնական բաժնի կողմից կայացված վարչական պատասխանատվության ենթարկելու որոշումները անվավեր ճանաչելու պահանջով «Իրավական ուղի» ՀԿ-ն դիմել է դատարան՝ ստանձնելով ակցիայի մասնակիցներից Իշխան Խոսրովյանի և Վրեժ Սարգսյանի շահերի ներկայացումը վարչական և դատական մարմիններում։

 

Այսօր ՀՀ վարչական դատարանը բավարարեց «Իրավական ուղի» իրավապաշտպան հասարակական կազմակերպության փաստաբան Դավիթ Ավագյանի՝ ՀՀ ոստիկանության Երևան քաղաքի վարչության կենտրոնական բաժնի 2019թ․-ի հունիսի 12-ի թիվ 028 որոշումը անվավեր ճանաչելու մասին պահանջը՝ ոչ իրավաչափ ճանաչելով նշված որոշումը։
