ՍԴ-ն վերիշխանական մարմին է, որի դիրքորոշումները պետք է լրիվ այլ պրիզմայով դիտարկվեն. Արամ Վարդեւանյան
POLITICSԵթե ՍԴ նախագահ Հրայր Թովմասյանի գործողություններն վերաբերյալ ուսումնասիրվում են եւ ոչ մի խնդիր չի հայտնաբերվում, մյուս կողմից, փաստացի, միջամտություն է լինում լիազորությունների իրականացմանը, ապա այդ վնասն ինչպե՞ս պետք է փարատվի կամ վերականգնվի։ Այս մասին NEWS.am-ի հետ զրույցում ասաց փաստաբան, սահմանադրագետ Արամ Վարդեւանյանը։
Վարդեւանյանի խոսքով՝ անձնական տվյալների հարցում միջամտությունը պետք է լինի օրենքով սահմանված կարգով. «Առավել եւս դատավորների մասով դատական օրենսգիրք-սահմանադրական օրենքը, ՍԴ-ի մասին սահմանադրական օրենքը. դրանք ցանկացած տեսակի քննչական կամ դատավարական գործողության համար հստակ երաշխավորում են առավել զգոնություն, զսպվածություն եւ գաղտնիության ռեժիմներ»։
Վարդեւանյանը շեշտեց, որ դատավորներն իրականացնում են արդարադատություն, Սահմանադրական դատարանի դատավորները՝ սահմանադրական արդարադատություն, հետեւաբար, ցանկացած դատավարական կամ քննչական բնույթի միջամտություններ պետք է լինեն այնպիսին, որ չխաթարեն իրենց՝ Սահմանադրությամբ վերապահված լիազորության, իրականացումը. «Եթե ուսումնասիրություններ են իրականացվում եւ ոչ մի խնդիր չի հայտնաբերվում, մյուս կողմից, փաստացի, միջամտություն է լինում լիազորությունների իրականացմանը, այդ վնասն ինչպե՞ս պետք է փարատվի կամ վերականգնվի։ Չափազանց բարձր զգուշավորություն պետք է ցուցաբերել»։
Հարցին՝ արդյոք ՍԴ նախագահ Հրայր Թովմասյանը քաղաքական հայտարարություններ անո՞ւմ է, Վարդեւանյանը պատասխանելիս հիշեցրեց 2003 թվականի նախագահական ընտրությունները. «Մի հետաքրքիր ժամանակահատվածի եւ որոշման հետ կապված վերլուծություն էի կատարում, որը մեծ քննարկման առարկա էր դարձել գրեթե 10 տարի առաջ։ 2003 թվականի նախագահական ընտրություններից հետո, ՍԴ-ն ճանաչելով ընտրությունների արդյունքների լեգիտիմությունը, զուգահեռաբար նաեւ խախտումներ էր արձանագրել։ Ընդհանուր առմամբ, ընտրությունների օրինականությունը ճանաչվեց։ ՍԴ-ն իր որոշման եզրափակիչ մասում, նաեւ որպես առաջարկություն, առաջարկել էր վստահության հանրաքվե անցկացնել։ Վստահության հանրաքվեն ընտրության վեճի հետ կապված շատերին կարող է թվալ քաղաքական դիրքորոշում, բայց այն ՍԴ-ի որոշում էր, որի հետ կապված եղան եւ՛ քննադատություններ, եւ՛ աջակցություններ։
Արամ Վարդեւանյանն ասաց, որ ՍԴ նախագահի հայտարարություններին հետեւում է եւ քաղաքական բնույթի հայտարարություններ չի լսել.
«ՍԴ-ն կարող է ցանկացած տեսակ իրավիճակային գնահատական տալ, ի վերջո, ՍԴ-ն նաեւ գնահատում է քաղաքացիական եւ քաղաքական իրավունքների հետ կապված իրավիճակը։ Հետեւաբար, ՍԴ-ից ակնկալել այնպիսի իրավիճակ, ինչպիսին կարելի է ակնկալել ընդհանուր իրավասության դատարանից, հնարավոր չէ։ ՍԴ-ն վերիշխանական մարմին է, որի դիրքորոշումները պետք է լրիվ այլ պրիզմայով դիտարկվեն»։
