Սահմանադրական դատարանի նախագահ Հրայր Թովմասյանի հայտարարությունը.

 

«Սիրելի՛ հայրենակիցներ, գործընկերներ

 

Ստիպված եմ արձագանքել մամուլի ասուլիսում ՀՀ վարչապետ Նիկոլ Փաշինյանի կողմից ինձ վերագրված շինծու և իրականությանը չհամապատասխանող հերյուրանքներին:

 

Հարկ եմ համարում հայտնել, որ Ն. Փաշինյանի՝ վարչապետ դառնալուց հետո ես նրա հետ հեռախոսով խոսել եմ ընդամենը երկու անգամ։

 

Մեկ անգամ նա ինձ խնդրել է Սահմանադրական դատարանի քննության առարկա միջազգային պայմանագրով քննությունն իրականացնել հնարավորինս սեղմ ժամկետում, քանի որ դա անհրաժեշտ է ՀՀ միջազգային պարտավորությունների կատարման համար։

 

Երկրորդ անգամ հեռախոսազանգը եղել է իմ նախաձեռնությամբ՝ Գերմանիայի Սահմանադրական դատարանի նախագահ պարոն Անդրեաս Ֆոսկեուլեի ՀՀ այցելության շրջանակներում իր հետ հանդիպում կազմակերպելու առնչությամբ:

 

Ես երբեք առերես որևէ հանդիպում չեմ ունեցել Նիկոլ Փաշինյանի հետ, որը եղել է տեսախցիկների տեսադաշտից դուրս։ Նրա պաշտոնավարման օրոք, բացառությամբ Ա. Ֆոսկուլեի հետ հանդիպման, երբեք չեմ եղել կառավարությունում կամ կառավարական ամառանոցում, իսկ Փաշինյանը երբեք չի եղել Սահմանադրական դատարանում, իմ աշխատասենյակում կամ որևէ այլ վայրում։

 

Իմ պաշտոնավարման մասով երբեք որևէ առաջարկություն չեմ ներկայացրել ո՛չ Փաշինյանին, ո՛չ էլ իշխանության որևէ ներկայացուցչի։

 

Ես պահանջում եմ, որ Փաշինյանը հրապարակավ վկայակոչի գոնե մեկ արժանահավատ փաստ, մեկ օբյեկտիվ փաստական տվյալ, որ ես 2018 թվականի մայիսից սկսած գեթ մեկ անգամ ուղղակի կամ անուղղակի ձևով, առերես կամ միջնորդավորված եղանակով իր կամ իշխանության որևէ այլ ներկայացուցչի առաջարկել եմ «իմ ծառայությունները», «առաջարկել եմ իրենց անել որևէ քայլ», որը կնպաստի նրան, որ Փաշինյանը կամ նրա քաղաքական ուժն ինչ-որ մի եղանակով սատարի ինձ կամ ՀՀ սահմանադրական դատարանը։

 

Սա ասում և պնդում եմ՝ որպես Հայաստանի Հանրապետության քաղաքացի և հայ տղամարդ, ում համար պատիվն ու արժանապատվությունը վեր է ամեն ինչից, իսկ սուտն ու կեղծիքը՝ անընդունելի և դատապարտելի է՝ հատկապես, երբ այն հնչում է բարձրաստիճան պաշտոնյայի շուրթերից։

 

Այս պահից սկսած ես ուղիղ 20 օր համբերատար սպասելու եմ, որ Փաշինյանը հրապարակի իր խոսքերն հիմնավորող որևէ օբյեկտիվ փաստ, ցանկացած վստահելի ապացույց։

 

Դա չանելու դեպքում իմ փաստաբաններին խնդրելու եմ զրպարտության վերաբերյալ հայց ներկայացնել Նիկոլ Փաշինյանի դեմ»,-մեջբերման ավարտ:
