Սահմանադրական փոփոխությունների իրականացումը պայմանավորված է միայն իշխանությունների շահերով. «Փաստ»
ANALYSIS«Փաստ» թերթը գրում է․
Ազգային ժողովի խմբակցություններն արդարադատության նախարարությանն են ներկայացրել սահմանադրական փոփոխությունների մասնագիտական հանձնաժողովի կազմում իրենց ներկայացուցիչներին։
Այն բանից հետո, երբ արդարադատության նախարարը վարչապետի հաստատմանը կներկայացնի անհատական կազմի վերաբերյալ որոշման նախագիծը, կմեկնարկեն նաև հանձնաժողովի աշխատանքները:
Սա արդեն իսկ նշանակում է, որ իշխանությունների կողմից սահմանադրական փոփոխությունների նախաձեռնությունը գործնական փուլ է թևակոխում։
Դեռևս 2018 թվականից սկսած՝ վարչապետ Փաշինյանը պարբերաբար խոսում էր սահմանադրական փոփոխություններ կատարելու անհրաժեշտությունից։ Վերջինս նշում էր, թե այդ փոփոխությունների արդյունքում պետք է կրճատել վարչապետի ձեռքում կենտրոնացած որոշակի լիազորություններ, իսկ դրա փոխարեն ընդլայնել ՀՀ նախագահի լիազորությունները։
Դրանով կարծես թե նա ցանկանում է փարատել այն մտահոգությունները, թե ինքը չի պատրաստվում հանդուժել շատերի, ինչպես նաև ժամանակին իր կողմից սուպերվարչապետական բնորոշվող կառավարման մոդելը, սակայն ինչպես ցույց է տալիս ժամանակը, Փաշինյանը նպատակ չունի վարչապետի լիազորությունների վերաբաշխում կատարել և հրաժարվել սուպերվարչապետությունից։
Պատահական չէ, որ «Իմ քայլը» խմբակցության ղեկավար Լիլիթ Մակունցը հայտարարել է, թե ինքն այս պահին կառավարման համակարգի փոփոխության անհրաժեշտություն չի տեսնում։
«Նիկոլ Փաշինյանը սուպերվարչապետական համակարգ ասելով նկատի ուներ, օրինակ, կեղծված ընտրությունների արդյունքում պարտադիր կերպով կամ ստիպողաբար ձևավորվող ՏԻՄ իշխանություններ», - նկատել է Մակունցը:
Ստացվում է, որ Մակունցը սուպերվարչապետական համակարգի առկայությունը պայմանավորում է կեղծված ընտրությունների հանգամանքով։ Եվ եթե ընտրություններն այլևս չեն կեղծվում, ուրեմն համակարգն արդեն սուպերվարչապետական չէ։
Մակունցը նմանատիպ հայտարարություն չէր անի, եթե, իհարկե, իշխանությունը մտադրություն ունենար կատարել վարչապետի լիազորությունների վերաբաշխում։ Այդ դեպքում հարց է ծագում՝ եթե կառավարման համակարգում էական փոփոխություններ չեն նախատեսվում, ապա ի վերջո ո՞րն է կրկին սահմանադրական փոփոխությունների գնալու իմաստը, քանի որ վերջին սահմանադրական փոփոխություններից անցել է ընդամենը 5 տարի։
Այս պարագայում պետք է ուշադրության արժանացնել Լիլիթ Մակունցի այն հայտարարությունը, թե սահմանադրական փոփոխությունների փաթեթում իրենց շեշտադրումը լինելու է դատաիրավական համակարգի բարեփոխումների վրա։
Նման իրավիճակում արդեն տպավորություն է առաջանում, որ սահմանադրական փոփոխությունների հիմքում ընկած է այն հիմնական մտադրությունը, որ պետք է վերակազմավորել ներկայումս գործող Սահմանադրական դատարանը և ազատվել ինքնուրույն որոշումներ ընդունող դատավորներից, որոնք համառորեն չեն ցանկանում թոշակի գնալ և կատարել իշխանությունների կամքը։
Եվ պատահական չէ, որ արդեն տեղեկություններ են շրջանառվում իշխանության՝ ՍԴ-ն ու Վճռաբեկ դատարանը միավորելու մտադրության մասին։ Ստացվում է, որ սահմանադրական փոփոխությունների իրականացումը պայմանավորված է ոչ թե պետության առջև ծառացած խնդիրների լուծման անհրաժեշտությունից, այլ միայն իշխանությունների շահերով։
Իսկ թե որքանով ժողովրդի համար ընդունելի կլինեն նման օրակարգով սահմանադրական փոփոխությունները, ցույց կտա ժամանակը։
Սակայն բացառված չէ, որ սահմանադրական փոփոխությունների օրակարգը, կապված իշխանության վարկանիշի անկման և հանրության շրջանում տրամադրությունների փոփոխության հետ, տապալվի, և իշխանությունը չկարողանա հասնել իր քաղաքական նպատակադրումներին։
