ՀՀ պետական գույքի կառավարման կոմիտեից ստացված փաստաթղթերը ՀՀ գլխավոր դատախազության պետական շահերի պաշտպանության վարչության կողմից ուսումնասիրության ընթացքում պարզվել է, որ ՀՀ պետական գույքի կառավարման վարչության պաշտոնատար անձինք, խախտելով «Անշարժ գույքի գնահատման գործունեության մասին» ՀՀ օրենքի պահանջները՝ առանց իրավական հիմքի և պայմանագիր կնքելու, 2016թ. ՍՊԸ-ին առաջարկել են իրականացնել գույքերի գնահատման աշխատանքներ, տեղեկացնում է Գլխավոր դատախազությունը։

 

Նշված առաջարկի հիման վրա ՍՊԸ-ն 23.08.2017թ. իրականացրել է ք. Երևան, Կենտրոն համայնք, Լեոյի փողոց 54 հասցեում գտնվող 2503.4 քմ մակերեսով վարչական շենքի, 55.9 քմ մակերեսով կաթսայատան և 0.12 հա մակերեսով հողամասի գնահատում, ինչի արդյունքում նշված անշարժ գույքը գնահատվել է 515.890.000 ՀՀ դրամ:

Նշված գնահատման հիման վրա 17.05.2018թ. վերը նշված գույքը մրցութային կարգով 360.620.000 ՀՀ դրամով օտարվել է:

Հետագայում կատարվել է վերը նշված անշարժ գույքի 2017թ. շուկայական արժեքի վերլուծություն, ինչի արդյունքում պարզվել է, որ օտարված գույքի շուկայական արժեքը 2017թ. դրությամբ կարող էր կազմել ոչ թե 515.890.000 ՀՀ դրամ, այլ՝ 850.000.000 ՀՀ դրամ կամ շուրջ 1.5 անգամ ավել սկզբնական գնահատված արժեքից:

Պարզվել է նաև, որ ՍՊԸ-ի կողմից նշված անշարժ գույքի գնահատման գործընթացում խախտվել են գնահատման ստանդարտի պահանջները, մասնավորապես՝ հաշվի չի առնվել գնահատվող գույքի նպատակային նշանակությունը, մակերեսը:

Այսպիսով, արձանագրված փաստերը վկայում են, որ ՀՀ պետական գույքի կառավարման վարչության պատասխանատու պաշտոնատար անձինք, պաշտոնեական դիրքը ծառայության շահերին հակառակ օգտագործելով, խախտելով «Անշարժ գույքի գնահատման գործունեության մասին» ՀՀ օրենքի պահանջները՝ առանց իրավական հիմքի և պայմանագիր կնքելու, 2016թ. ՍՊԸ-ին առաջարկել են իրականացնել ք. Երևան, Կենտրոն համայնք, Լեոյի փողոց  54 հասցեում գտնվող գույքի գնահատման աշխատանքներ:

Արդյունքում ՍՊԸ-ի մասնագետը, խախտելով գնահատման ստանդարտի պահանջները, մասնավորապես՝ հաշվի չառնելով գնահատվող գույքի նպատակային նշանակությունը, մակերեսը՝ կազմել է կեղծ եզրակացություն, որով 850.000.000 ՀՀ դրամ իրական արժեքով գույքը գնահատվել է 515.890.000 ՀՀ դրամ, որն էլ հիմք է ընդունվել նշված անշարժ գույքի օտարման մրցույթի համար: Արդյունքում նշված գույքը օտարվել է իրական արժեքից շուրջ 3 անգամ պակաս՝ պետությանը պատճառելով շուրջ 489.380.000 ՀՀ դրամի վնաս՝ առաջացնելով ծանր հետևանքներ:

ՀՀ պետական գույքի կառավարման կոմիտեի, ինչպես նաև ՀՀ գլխավոր դատախազության պետական շահերի պաշտպանության վարչության իրականացրած ուսումնասիրության արդյունքներով ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի 2-րդ մասով նախատեսված հանցագործության հատկանիշներով հարուցվել է քրեական գործ:

Նախաքննության կատարումը հանձնարարվել է ՀՀ քննչական կոմիտեին:

Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
