Բալային համակարգը իրավական առումով աբսուրդի ժանրից է և խոցելի: Այս մասին իր ֆեյսբուքյան էջում գրել է տնտեսագետ Ատոմ Մարգարյանը:

 

«Բալային համակարգը իրավական առումով աբսուրդի ժանրից է և խոցելի։ Միևնույն իրավախախտման համար մարդուն կարելի է պատժել կամ դատել միմիայն մեկ անգամ։ Սա դեռևս Հին հռոմեական իրավունքից եկող և միջազգային բազմաթիվ իրավական փաստաթղթերում ամրագրված կանոն է, որոնց միացել է նաև Հայաստանի Հանրապետությունը։ Օրինակ՝ «Մարդու քաղաքացիական և քաղաքական իրավունքների միջազգային խարտիայի» 14-րդ հոդվածն ասում է. «Ոչ ոք չպետք է դատվի կամ կրկնակի պատժվի այն իրավախախտման համար, որի համար նա վերջնականապես պատժվել կամ արդարացվել է՝ համապատասխան տվյալ երկրի օրենսդրությանը»։ Դարերից եկող այս սկզբունքը («non bis in idem») գիտի իրավաբանությունից տարրական գիտելիքներ ունեցող յուրաքանչյուր ոք։

 

Հիմա հարցեր. մոտ երեք տասնյակ ճանապարհատրանսպորտային խախտումների համար տուգանքներ գանձելով (ասել է թե՝ պատժելով) մենք հետո դրանք ինչու՞ ենք հաշվի առնում համադրված տուգանային բալերի մեջ ու մի հատ էլ կրկնակի պատժում՝ զրկելով վարորդական իրավունքից, երբ պարզ իրավական կանոնը հուշում է, որ դա պարզապես արգելված է։ Արդեն օրենք դարձած ու գործողության մեջ դրված նախագիծը պատրաստած, գործադիրում քննարկած, ԱԺ-ում դակած հարյուրավոր մարդիկ գաղափար ունեցե՞լ են այս պահանջից, թե՞ ոչ։ Երբ որ ԱԺ ընդունած օրենսդրական փոփոխությունների այս փաթեթը հասել է նախագահին, նա գոնե մի պահ մտածե՞լ է, որ ստորագրելուց առաջ այն կարելի էր ուղարկել Սահմանադրական դատարան՝ կարծիքի։

 

Այն, որ մեր ճանապարհներին խայտառակ վիճակ է ու ով ինչպես ուզում՝ այնպես քշում է, փաստ է ու վիճարկելի չէ։ Բայց վարորդները տարբեր են՝ ոմանք վերին աստիճանի բարեխիղճ են, իսկ ոմանք էլ ղեկին՝ չարամիտ խուլիգաններ։ Ցավոք մեր երկրում երթևեկության պայմաններն անտանելի են ու մարդիկ հաճախ խախտումներ են անում ակամա, իրենցից անկախ պատճառներով (խորթուբորդ ճանապարհներ, գծանշումների վատ որակ կամ բացակայություն, լուսացույցերի անկանոն աշխատանք, երթևեկության այլ մասնակիցների սադրանք և այլն)։ Ու բալային համակարգը, այն ձևով, ինչ ներդրվել է, չի լուծելու խնդիրները։ Այն ուղղակի մեծացնելու է լարվածությունը ճանապարհներին, վարորդների մոտ՝ սխալվելու հավանականությունը, և արդյունքում՝ խախտումների վիճակագրությունը շարունակելու է աճել՝ հետն էլ՝ մարդկանց դժգոհությունը»,- գրել է նա։
