Դատավորների հայտարարությունը. հանրությունը մեծամասնությանը չպետք է թողնի մենակ
SOCIETYՍահմանադրական դատարանի յոթ դատավորներ հայտարարություն են տարածել, որով կոչ են արել Հատուկ քննչական ծառայությանը ՍԴ նախագահ Հրայր Թովմասյանի դեմ քրգործում մնալ օրենքի խստագույն սահմանի շրջանակում: Դատավորները հայտարարել են, որ անկախ ամեն ինչից շարունակում են բնականոն աշխատանքն ու կատարում դատավորի իրենց կոչումն ու առաքելությունը:
Մամուլում շրջանառվել է Գերագույն դատարանի ստեղծման գաափարը, որպես վարկած, որ առկա է իշխանության սցենարային պաշարում: Իշխանությունը պաշտոնապես չի բարձրաձայնել որևէ վարկած: Այստեղ կա մի խնդիր, որ դեռևս պարզ չէ, թե ի վերջո արդյո՞ք կառավարող մեծամասնության շրջանակում առկա է որևէ ընդհանուր մոտեցում այդ հարցի շուրջ, թե՞ հարցը լուծվելու է վարչապետ Փաշինյանի մոտեցմամբ: Բայց, ի վերջո կարիք կա հստակեցնելու, թե որն է հարցը՝ անցանկալի դատավորին կամ դատավորներին հեռացնե՞լը, թե՞ դատական լայն ռեֆորմն ու արդարադատության նոր համակարգի ձևավորումը: Որովհետև, եթե հստակ չէ որն է հարցը, ապա մեղմ ասած բարդ է գտնել հարցի լուծման մեխանիզմներ: Իսկ այստեղ պատասխանը պետք է լինի նաև հանրային դաշտում, որովհետև ի վերջո կառավարող մեծամասնությանն ու վարչապետին տված իր ամբողջ վստահությամբ հանդերձ, հանրությունը պետք է արձանագրի մի պարզ իրողություն՝ որ նոր իշխանությունը ունի իր օրակարգային հարցերն ու շահերը հենց միայն իշխանություն լինելու բերումով, և այստեղ միանգամայն օբյեկտիօվ հավանականություն կա, որ ոչ միշտ է, որ դրանք կարող են բացարձակորեն համընկնել այդ իշխանությանը վստահության մեծ քվե տված հանրության շահերին:
Եվ այստեղ շատ կարևոր է, որ հանրությունն իշխանությանը չթողնի մենակ, ու դա ենթադրում է ոչ թե կենացի կամ ուռահայրենասիրական պաթոսի մակարդակի աջակցությունն ընդդեմ որևէ անձի կամ խմբի՝ իշխանությունը որևէ անձի կամ խմբի դեմ բավական ուժեղ է առանց այդ պաթետիկ աջակցության էլ, այլ հենց խնդիրների հանրային սահմանում այդ իշխանության համար: Որպեսզի փնտրվող լուծումներում էլ գերակշռի ոչ թե այն, ինչը համապատասխանում է իշխանությունից բխող կարգավիճակից ենթադրվող սուբյեկտիվ քաղաքական շահին, այլ այն, ինչը թելադրվում է հանրային հեռանկարային շահով:
