«Սասնա ծռերի» գործով ամբաստանյալի նկատմամբ դատական սանկցիա կիրառելուց հետո դատարանը վերանայեց որոշումը

Երեւանի ընդհանուր իրավասության դատարանի Շենգավիթի նստավայրում՝ դատավոր Մեսրոպ Մակյանի նախագահությամբ, ընթացող «Սասնա Ծռերի» գործով ամբաստանյալների հարցաքննության ժամանակ հարցաքննվող Արեգ Կյուրեղյանի նկատմամբ դատարանը դատական սանկցիա կիրառեց, նրան 20 ժամով հեռացնելով նիստերի դահլիճից, սակայն լսելով կողմերի կարծիքներն ու ներկայացված միջնորդությունը՝ վերանայեց այդ որոշումը։

 

Կյուրեղյանն իր ելույթում ասել էր, որ ՊՊԾ գնունդ մուտք գործելը եղել է ապստամբություն, սակայն իրենց մեղադրական եզրակացությունում դրա մասին բառ անգամ չկա. «Մեզ առաջադրված մեղադրանքը կեղծ է։ ՊՊԾ-ն ազատագրված է եղել, ոչ թե զավթված։ ՊՊԾ գունդը եղել է չարիք, չի գործել Հայաստանի շահերից։ 2016 թվականի դեպքերի հետ կապված այս դատարան կոչեցյալը Հայաստանի բազում անմեղ քաղաքացիների է դատապարտել կամ կալանավորման որոշում կայացրել եւ ուղարկել բանտ, այդ թվում եւ անձամբ դուք։ Հետագայում պարզվել է, որ այդ քաղաքացիները անմեղ են»։

 

Նիստը նախագահող դատավորն ասաց, որ դատարանի նկատմամբ անհարգալից վերաբերմունքը շարունակելու դեպքում հեռացվելու է նիստերի դահլիճից եւ զրկվելու է ցուցմունք տալու հնարավորությունից։

 

Սակայն ամբաստանյալը շարունակեց. «Դատարան չկա, եւ դա միայն իմ տեսակետը չէ։ Հայաստանում չի գործում արդարադատություն»։

 

Դատարանը կրկին նկատողություն արեց, սակայն Կյուրեղյանը շարունակեց նույն միտքը, որից հետո դատարանը որոշեց 20 ժամով նրան հեռացնել դատական նիստերի դահլիճից։

 

Նրա պաշտպան Տիգրան Եգորյանը միջնորդեց, որ դատարանը թույլ տա շարունակել ամբաստանյալի հարցաքննությունը։

 

Միջնորդության միացան նաեւ գործով մյուս ամբաստանյալներն ու պաշտպանները, սակայն մեղադրող դատախազն ասաց, որ միջնորդությունն անհիմն է, եւ, որ Կյուրեղյանը դատարանի նկատմամբ անհարգալից վերաբերմունք է արտահայտել։

 

Նիստը նախագահող դատավորն ասաց, որ Կյուրեղյանի վարքագիծը դատական նիստերին դրական չի եղել, հաճախ է նկատողություն ստացել, հեռացվել է նիստերի դահլիճից։

 

Այնուամենայնիվ դատարանը բավարարեց պաշտպանի միջնորդությունը, եւ Կյուրեղյանը վերադարձվեց նիստերի դահլիճ՝ հարցաքննության. ««Դատարանը մնում է այն համոզման, եթե այդպիսի վարքագիծը շարունակվի, կարծում եմ, որ արդեն կողմերը երես էլ չեն ունենա միջնորդություն ներկայացնելու»։

 

Հիշեցնենք, որ 2016 թ. հուլիսի 17-ին զանգվածային անկարգություններ կազմակերպելու նախապատրաստության, ծանրացուցիչ հանգամանքներում սպանությունների, շենքեր, շինություններ, տրանսպորտի միջոցներ զավթելու, պատանդ վերցնելու եւ պահելու, ապօրինի կերպով հրազեն, ռազմամթերք ձեռք բերելու, պահելու, փոխադրելու, զենք, ռազմամթերք հափշտակելու, ուրիշի գույքը գաղտնի հափշտակելու եւ դիտավորությամբ ոչնչացնելու փաստի կապակցությամբ հարուցված քրեական գործերը քննվում են դատարաններում։

 

Զինված հարձակման հետեւանքով զոհվել են գնդապետ Արթուր Վանոյանը, լեյտենանտ Յուրի Տեփանոսյանն ու ավագ ենթասպա Գագիկ Մկրտչյանը։

 

ՊՊԾ գունդը զավթելու եւ նշված այլ արարաքները կատարելու մեջ մեղադրվում է 32 անձ:
