POLITICSՉի կարելի դուրս գալ փողոց, թեկուզ 3000 հոգու շրջանում հարցախույզ անել եւ արդյունքում համարել, որ դատարանների հանդեպ վստահությունը բարձր է կամ ցածր։ Այս մասին NEWS.am-ին ասել է ԱԺ նախկին փոխնախագահ, Արդարադատության նախկին նախարար Արփինե Հովհաննիսյանը։
«Նախեւառաջ ես «դատարանների հանդեպ վստահություն» եզրույթը չեմ ուզում գործածել այն իմաստով, որով գործածում են առավել լայն եւ ոչ իրավաբան հանրույթը, քանզի դա հատուկ չափման մեթոդոլոգիա ունի։ Նույնիսկ ինձ ու մյուս այլախոհների հետ ընդհանրապես չհանաձայնող մարդիկ, նույնիսկ նրանք, ովքեր ինձ քննադատում են, իրենք իրենց ներսում էլ, ներսից մի քիչ այս կողմ էլ հրաշալի գիտեն, որ ես ճիշտ եմ ասում։ Չի կարող դատական համակարգի նկատմամբ վստահությունը բարձրանալ, երբ ունես Դանիբեկյան Աննայի նման դատավոր՝ անհաղորդ տիկին, որն առհասարակ չի լսում՝ իրեն ինչ են ասում, ինչ են փաստարկում դատական նիստերի դահլիճում։ Տիկինը գիտի, որ ինքը սցենարիստի գրած սցենարում դերակատարում իրականացնող է եւ նա գալիս է այդ առաքելությամբ։ Չի կարող դատարանի նկատմամբ վստահությունը բարձրանալ անկախ այն բանից, որ իշխանությունը քարոզում է՝ այ, Ռոբերտ Քոչարյանին պետք է պատժել, մյուսին պետք է պատժել, դա նշանակություն չունի։ Որովհետեւ մարդիկ, որոնք այսօր պաշտպանում են իշխանությանը, վաղը, որ իշխանության հետ հակասություն ունենան ու դառնան հակաիշխանական, հիշելու են, որ այս նույն գործով այս դատավորը այսպես էր իրեն պահում ու այդ դատավորի մասին չեն ասելու՝ այ, դե եթե ինքը Քոչարյանին դատեց, ուրեմն շատ վտահելի դատավոր է, իրենք հասկանալու են, որ այդ դատավորը կամակատար է»։
«Չի կարող վստահությունը բարձրանալ, երբ Բարձրագույն դատական խորհրդի ղեկավարը Ռուբեն Վարդազարյանն է՝ մարդ, որը դատական համակարգում ավելի շատ առեւտրականի համբավ ունի այն առումով, որ միջնորդ է հանդիսանում տարբեր մարդկանց՝ դատավորներին ինչ-որ բան հասցնելու առումով, քան ապահովում է դատական համակարգի անկախությունը։ Բայց մի ճիշտ բան ասել է՝ իշխանությունը ցանկանում է ունենալ Արմեն Դանիելյանի եւ Աննա Դանիբեկյանի նման դատավորներ՝ կամակատար, հլու ծառաներ։ Այդ մարդիկ էլ իրենց արժանապատվության, դաստիարակության, իրավական գիտելիքների, սահմանադրության, օրենքների եւ վերջապես իրենց դեմ կոմպրոմատների թղթապանակի հաստությանը համահունչ կատարում են այն գործառույթը, որ իրենց տրված է։ Ես նույն պարոն Վարդազարյանի մասով, ամենայն հարգանքով հանդերձ, համարում եմ, որ սխալ էր նրան նշանակել դատարանի նախագահ եւ դա բարձրաձայնում եմ, բայց դա չի նշանակում, որ եթե մի բան սխալ է արվում, հիմա պետք է շարունակել է՛լ ավելի բարձրագոչ տեսքով ու ավելի բարձր պաշտոնի նշանակել, որտեղ այդ մարդը պարզապես չգիտեմ ինչ պիտի անի»։
Արփինե Հովհաննիսյանը պնդել է, որ որպես Արդարադատության նախարար, երբեւէ անմիջական ազդեցություն չի ունեցել համակարգի վրա, ու ոչ մի նախարար, այդ թվում՝ պարոն Բադասյանը չունի.
«Բայց ինստիտուցիոնալ առումով փորձել եմ բարեփոխումների միջոցով ցավոտ, երկար, անշնորհակալ գործի միջոցով հասնել ինչ-որ քայլերի։ Սա՛ է ճանապարհը դատաիրավական համակարգը կարգի բերելու։ Այն ճանապարհով, որով հիմա կատարվում է, այդպես չի լինի», ասել է նա։
