ՀՀ 3-րդ նախագահ Սերժ Սարգսյանին որպես մեղադրյալ ներգրավելու մասին որոշումը վերացնելու վերաբերյալ նրա պաշտպան Ամրամ Մակինյանի բողոքը դատախազի որոշմամբ՝ մերժվել է՝ անհիմն լինելու պատճառաբանությամբ: Այս մասին ԼՈՒՐԵՐ․com-ի հետ զրույցում հայտնեց Գլխավոր դատախազության հանրային կապերի բաժնի պետ Արևիկ Խաչատրյանը։

 

«ՀՀ 3-րդ նախագահի պաշտպանի բողոքի հիմքում դրված էր այն հանգամանքը, որ 3-րդ նախագահին վերագրվել է այնպիսի ենթադրյալ արարք, որը բխել է նրա կարգավիճակից և գործունեությունից։ Սակայն Վճռաբեկ դատարանը, դեռևս 2018 թ. նոյեմբերի 15-ի թիվ ԵԴ/0743/06/18 որոշմամբ արտահայտել է իրավական դիրքորոշում, ըստ որի՝ «Եթե նախագահն իր լիազորություններն իրականացնելիս առաջնորդվել է իր մասնավոր, անձնական շահով կամ չի ունեցել համապատասխան գործողությունն իրականացնելու լիազորություն կամ դա իրականացրել է Սահմանադրությամբ իրեն վերապահված լիազորությունների անցմամբ, ապա նման գործողությունները չեն կարող առնչություն ունենալ նախագահի կարգավիճակի հետ և պետք է գնահատվեն որպես նախագահի կարգավիճակի հետ չկապված»,- նշեց Խաչատրյանը: 

 

Նրա խոսքով՝ քրգործի նյութերի ուսումնասիրության արդյունքում դատախազը եկել է եզրակացության, որ Սերժ Սարգսյանին որպես մեղադրյալ ներգրավելու մասին որոշմամբ՝ նրան մեղսագրված գործողություններն անգամ ձևական առումով որևէ աղերս չունեն ՀՀ նախագահի կարգավիճակի հետ, հետևաբար բացակայում է անձեռնմխելիության սահմանադրական երաշխիքը։

 

Հիշեցնենք, որ դեկտեմբերի 4-ին ՀՔԾ-ն հայտարարեց, որ իրենց վարույթում քննվող դիզվառելիքի վերաբերյալ քրեական գործի նախաքննության ընթացքում ձեռք բերված բավարար ապացույցների համակցության հիման վրա Սերժ Սարգսյանին մեղադրանք է առաջադրվել վատնման եղանակով առանձնապես խոշոր չափի՝ մոտ կես միլիարդ ՀՀ դրամի հափշտակություն կազմակերպելու համար: Նրա նկատմամբ որպես խափանման միջոց է ընտրվել չհեռանալու մասին ստորագրությունը:
