Դատարան ենք դիմել, որպեսզի ԱԱԾ-ն պարտավորվի քրեական գործ հարուցել 4 անձանց նկատմամբ.«Ադեկվադ»
SOCIETY«Ադեկվադ» միաբանության ղեկավար Արթուր Դանիելյանը դիմել է Երևանի ընդհանուր իրավասության դատարան՝ պահանջելով ԱԱԾ տնօրենի ժամանակավոր պաշտոնակատարին պարտավորեցնել քրեական գործ հարուցել իրավապահ 4 մարմինների ղեկավարների նկատմամբ: Այս մասին Tert.am-ին ասել է «Ադեկվադ» միաբանության անդամ, իրավաբան Գարեգին Պետրոսյանը:
«Եթե դատարանը բավարարի բողոքարկումը, ԱԱԾ-ն արդեն պարտավոր է լինելու հարուցել քրեական գործ և քննել 4 անձանց՝ նախկին ոստիկանապետ Վալերիյ Օսիպյանի, ոստիկանության պետի պաշտոնակատար Արման Սարգսյանի, գլխավոր դատախազ Արթուր Դավթյանի և ՀՔԾ պետ Սասուն Խաչատրյանի արարքներում հանցակազմի առկայությունը»,- նշել է Գարեգին Պետրոսյանը:
Իրավաբանը հիշեցրել է, որ 2019 թ. մայիսի 19-ին վարչապետ Նիկոլ Փաշինյանը ֆեյսբուքյան կոչով դիմել էր հանրությանը, որպեսզի հաջորդ օրը՝ մայիսի 20-ին, մարդիկ շրջապատեն բոլոր դատարանների շենքերը: Ըստ «Ադեկվադ» միաբանության` սա հանրային հավաքի կոչ էր, որի դեպքում, Հավաքների ազատության մասին օրենքի համաձայն՝ հավաքի կազմակերպիչը պարտավոր էր իրազեկել բոլոր այն համայնքների ղեկավարներին, որտեղ կային դատարանների նստավայրեր:
«Ոստիկանությունից մեզ հայտնել էին, որ իրազեկումը չի իրականացվել, այդ դեպքում անհրաժեշտ էր դիմել վարչական դատարան, որպեսզի վարչական իրավախախտումների վերաբերյալ օրենսգրքով նախատեսված զանցակազմի համար վարչապետ Փաշինյանը պատասխանատվության ենթարկվի՝ համայնքների ղեկավարներին չիրազեկելու համար: Ոստիկանությունից մեզ հայտնեցին, որ հավաքի կազմակերպիչը Նիկոլ Փաշինյանը չէ: Հետո արդեն Արման Սարգսյանի պաշտոնավարման ժամանակ դիմեցինք, այդ ժամանակ էլ ասացին, որ շտապ հավաք է եղել»,- ասել է Գարեգին Պետրոսյանը, ըստ որի՝ ոստիկանապետերի արարքներում առկա է ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի առաջին մասով նախատեսված պաշտոնեական լիազորությունները չարաշահելու հանցակազմ:
Դրանից հետո միաբանության անդամները դիմել են Դատախազություն և Հատուկ քննչական ծառայություն, սակայն ՀՔԾ պետն ու գլխավոր դատախազը հրաժարվել են քրեական գործ հարուցել:
«Հետո դիմեցինք ԱԱԾ 4 հոգու՝ ոստիկանության նախկին և գործող պետերին, գլխավոր դատախազին և ՀՔԾ պետին քրեական պատասխանատվության ենթարկելու համար: ԱԱԾ-ից հայտնել էին, որ հաղորդման մեջ չկա ոչինչ հանցագործության փաստերի վերաբերյալ: Հիմա դատարան ենք դիմել, որպեսզի ԱԱԾ-ն պարտավորված լինի քրեական գործ հարուցել 4 անձանց նկատմամբ»,- պարզաբանել է Գարեգին Պետրոսյանը:
