ՍԴ-ի կեղծ ճգնաժամի պատրվակով գնում ենք իրական ճգնաժամի․ Շաքե Իսայան
POLITICSՍահմանադրական դատարանի կեղծ ճգնաժամի պատրվակով գնում ենք իրական ճգնաժամի։ Այս մասին այսօր՝ դեկտեմբերի 10-ին, «Սահմանադրական դատարանի մասին» սահմանադրական օրենքում փոփոխություններ և լրացումներ կատարելու մասին նախագծի քննարկման ժամանակ ասաց ԱԺ «Բարգավաճ Հայաստան» խմբակցության պատգամավոր Շաքե Իսայանը՝ դիմելով արդարադատության նախարար Ռուստամ Բադասյանին։
Շաքե Իսայանը հետաքրքրվեց նախարարից, թե ինչու է հունվարի 31-ի փոխարեն վերջնաժամկետ սահմանվել ընդունումից հետո երկամսյա ժամկետը։ Բադասյանն ասաց, որ ԱԺ պետաիրավական հարցերի հանձնաժողովում առաջարկ է հնչել, որ ոչ թե մինչև հունվարի 31-ը, այլ ուժի մեջ մտնելուց հետո 2 ամսվա ընթացքում լինի վերջնաժամկետը, «որովհետև նախագիծը պրոցես պետք է անցնի, նախագահի կողմից ստորագրվի, և այնպես չլինի, որ այդ ընթացքը ընդունումից հետո շատ քիչ լիներ, հնարավոր չլիներ կողմնորոշվել»։
Իսկ հարցին, թե որն է նախագծի հետապնդած նպատակը, Բադասյանն ասաց, որ նոր մոդելի Սահմանադրական դատարան ունենալու խնդիրն է լուծում։
Իսայանը նաև հարցրեց՝ եթե միաժամանակ 7 դատավոր հետևի նախագծին և անցնի վաղ կենսաթոշակի, արդյոք ճգնաժամ չի առաջանա․ «Կեղծ ՍԴ-ի ճգնաժամի պատրվակով գնում ենք իրականա ճգնաժամի, սա է այն ճանապարհը որով ուզում ենք գնալ»։
Բադասյանը պատասխանեց․ «Չեմ կիսում ձեր կարծիքը, որ ունենք ՍԴ կեղծ ճգնաժամ, շատ իրական ճգնաժամ է»։ Նա նաև հավելեց, որ 3-ից ավելին լինեն ՍԴ դատավորները, որոնք կցանկանան հրաժարական տալ և անցնել վաղ կոնսաթոշակի, ապա ՍԴ դատավորի թափուր տեղի համար ընտրությունն անցկացվում է սահմանված ՍԴ դատավորի թափուր տեղի համար թեկնածուների առաջադրման ժամկետի ավարտից հետո 15-օրյա ժամկետում։
