ԱԺ-ն քննարկում է զինծառայողին ինքնասպանության դրդելու պատիժը խստացնող օրինագիծը
POLITICSՀՀ Ազգային ժողովում քննարկվում է զինծառայողին ինքնասպանության դրդելու համար նախատեսված պատիժը խստացնող օրենքի նախագիծը:
ՀՀ քրեական օրենսգրքում լրացում կատարելու մասին օրենքի նախագիծը հեղինակել են ՀՀ ԱԺ «Բարգավաճ Հայաստան» խմբակցության անդամներ Նաիրա Զոհրաբյանը, Վահե Էնֆիաջյանը, Շաքե Իսայանը և Արման Աբովյանը:
Օրենքի նախագծով առաջարկվում է օրենսգիրքը լրացնել նոր հոդվածով, որով առաջարկվում է սահմանել զորամասում կամ զինվորական ծառայություն կրելու այլ վայրում զինծառայողին սպառնալիքի, բռնության, դաժան վերաբերմունքի կամ անձնական պատիվն ու արժանապատվությունը նվաստացնելու միջոցով անուղղակի դիտավորությամբ կամ անզգուշությամբ ինքնասպանության կամ ինքնասպանության փորձի հասցնելը մեկ այլ զինծառայողի կողմից՝ պատժվում է ազատազրկմամբ՝ 3-8 տարի ժամկետով: Մի խումբ անձանց կողմից, պետի կողմից ստորադասի նկատմամբ, միևնույն անձի նկատմամբ՝ պարբերաբար, մարտական հերթապահության կամ մարտական ծառայության կրելու ընթացքում ինքնասպանության դրդելը պատժվում է ազատազրկմամբ՝ 5-10 տարի ժամկետով, իսկ սույն հոդվածով նախատեսված արարքները, որոնք կատարվել են ռազմական դրության, պատերազմի ժամանակ կամ մարտի պարագաներում՝ պատժվում է ազատազրկմամբ՝ 7-12 տարի ժամկետով:
Հիմնական զեկուցող Նաիրա Զոհրաբյանի խոսքով՝ ՀՀ զինված ուժերում տարիներ շարունակ խաղաղ պայմաններում արձանագրվող ինքնասպանությունների դեպքերը խոսում են ոչ պատշաճ կանոնադրական հարաբերությունների մասին: Նրա կարծիքով՝ մենք գործ ունենք Զինված ուժերում կարգապահության, կանոնադրական հարաբերությունների հետ կապված լուրջ խնդիրների հետ, և այս հարցերը բարձրացվում են որպես հանրային պահանջ՝ Զինված ուժերում զինծառայողին ինքնասպանության հասցնելու հանցագործություն կատարողներին ենթարկելու ավելի խիստ պատժի:
Կառավարությունը նախագծին տվել է դրական եզրակացություն և ներկայացրել մի շարք առաջարկներ, որոնք ընդունելի են եղել հիմնական զեկուցողի կողմից:
Նոյեմբերի 29-ին նախագիծը ՀՀ ԱԺ պետական-իրավական հարցերի մշտական հանձնաժողովի հերթական նիստի ընթացքում ստացել էր դրական եզրակացություն:
