Ցմահ դատապարտյալ Աշոտ Մանուկյանի վաղաժամկետ ազատման մասով դիմումի դատաքննությունը հետաձգվեց

24 տարի պատիժը կրող ցմահ դատապարտյալ Աշոտ Մանուկյանի վաղաժամկետ ազատման մասով դիմումի դատաքննությունն այսօր՝  դեկտեմբերի 2-ին հետաձգվեց։ Այս դատական նիստին Աշոտ Մանուկյանը ներկա չէր։ Դատարանը լսեց 2 կողմերի ներկայացուցիչներին, սակայն Աշոտ Մանուկյանի ներկա չլինելու պատճառով դատարանը որոշեց նիստը հետաձգել դեկտեմբերի 19-ին։

 

Հիշեցնենք, որ դատապարտյալն անազատության մեջ է 1996 թվականից: Մեղադրվել և դատապարտվել է երեք զինծառայողի սպանության համար: Մանուկյանը հեղինակել է «Հանցագործություն, ողբերգություն, տառապանքներ...» անունը կրող գրքույկը, որում պատմում է 23 տարի առաջ տեղի ունեցած իրադարձությունների և դրանց հետևանքով ցմահ ազատազրկված լինելու, իր զղջման մասին՝ երիտասարդներին հորդորելով չկրկնել իր սխալը:

 

 

Նշենք, որ Մանուկյանի վաղաժամկետ ազատման վերաբերյալ Արդարադատության նախարարության քրեակատարողական ծառայությունը՝ բացասական, իսկ պրոբացիոն ծառայությունը դրական եզրակացություն է տվել: Նման պայմաններում «Արմավիր» քրեակատարողական հիմնարկը, որում պահվում է դատապարտյալը, միջնորդագիր է տարել դատարան՝ վաղաժամկետ ազատման վերաբերյալ որոշում կայացնելու համար: Աշոտ Մանուկյանը 24 տարի առաջ մեղադրվել է երեք զինծառայողի սպանության համար և գնդակահարության դատապարտվել, սակայն դատավճիռն ի կատար չի ածվել, և 2003 թվականին, ինչպես գնդակահարության դատապարտված այլ անձանց, նրա պատիժը ևս փոխարինվել է ցմահ ազատազրկմամբ: 20 տարեկանում հանցանք կատարած Մանուկյանն այժմ 44 տարեկան է: Ինչպես քրեակատարողական ծառայությունն, այնպես էլ պրոբացիոն ծառայությունն արձանագրել են, որ Աշոտ Մանուկյանը պատժի կրման ընթացքում դրական վարքագիծ է դրսևորել, քրեական ենթամշակույթի նկատմամբ բացասական վերաբերմունք ունի, ակտիվորեն մասնակցել է վերասոցիալականացման միջոցառումներին: Սակայն, քրեակատարողական ծառայությունը գտել է, որ Մանուկյանի հանցանք կատարելու հավականությունը բարձր է: Պրոբացիոն ծառայությունն էլ թեև դատապարտյալի հանցանք կատարելու հավանականությունը ցածր է գնահատել ու նպատակահարմար գտել նրա վաղաժամկետ ազատումը`հանդես է եկել առաջարկությամբ, որը նրա պաշտպան Միհրան Պողոսյանը ոչ իրավաչափ է համարում: Մասնավորապես` ծառայությունն առաջարկել է պայմանական վաղաժամկետ արձակման հարցը քննարկելիս դատապարտյալի նկատմամբ նշանակել դատահոգեբանական փորձաքննություն՝ պարզելու նրա հոգեբանական բնութագիրը, որն, ըստ պրոբացիոն ծառայության, կարող է էական ազդեցություն ունենալ նրա վերասոցիալականացման գործընթացի վրա:
