Լոռու մարզի դատախազության դատախազների անմիջական հսկողությամբ նախապատրաստված նյութերով ձեռք են բերվել առերևույթ փաստական տվյալներ Ալավերդի համայնքի սեփականություն հանդիսացած թվով 6 մանկապարտեզների շենքերի օտարման գործընթացում պաշտոնատար անձանց կողմից առերևույթ չարաշահումներ թույլ տալու վերաբերյալ:
2019թ. նոյեմբերի 14-ին նյութեր նախապատրաստելու և ընթացքը լուծելու հանձնարարությամբ Լոռու մարզի դատախազի կողմից ՀՀ ոստիկանության Լոռու մարզային վարչության Թումանյանի բաժին է ուղարկվել ՀՀ Լոռու մարզպետ Ա․ Ղուկասյանի կողմից մարզի դատախազություն հասցեագրված գրությունը և կից փաստաթղթերը՝ Ալավերդի համայնքի ավագանու և համայնքի ղեկավարի կողմից 2003-2005թթ. ընթացքում անօրինական որոշումներ կայացնելու հետևանքով թվով 6 մանկապարտեզների շենք-շինություններն օտարելու և համայնքի օրինական շահերին էական վնաս պատճառելու վերաբերյալ։
Նյութերի նախապատրաստման ընթացքում փաստական տվյալներ են ստացվել այն մասին, որ Ալավերդու համայնքապետարանի իրավասու պաշտոնատար անձինք համայնքի սեփականություն հանդիսացող թվով 6 մանկապարտեզների, ինչպես նաև 280 տեղանոց՝ որպես մանկապարտեզ կառուցված անավարտ շենքերը, իրենց մերձավորներին կամ մտերիմներին օտարելու խմբային շահերից ելնելով, հիմք ընդունելով անշարժ գույքի գնահատումն իրականացնելու վերաբերյալ միևնույն անհատ ձեռնարկատիրոջ կողմից շինության իրական արժեքների վերաբերյալ կազմված կեղծ եզրակացությունները, 2003-2005թթ. ընթացքում, հրապարակային սակարկությունների օրենսդրության պահանջների խախտմամբ, համայնքի հաշվեկշռում գտնվող անշարժ գույքի նպատակային նշանակությունը կորցրած լինելու պատրվակով, օտարել են հիշատակված անշարժ գույքը: Ապա կարճ ժամանակ անց դրանց մի մասը ձեռք բերված արժեքը մի քանի անգամ գերազանցող գումարներով վաճառել են այլ անձանց, իսկ օտարված մյուս անշարժ գույքի նկատմամբ գրանցվել է այլ անձանց սեփականության իրավունքը: Այս ամենի արդյունքում Ալավերդի համայնքին պատճառվել է առանձնապես խոշոր չափերով վնաս:
Նախադպրոցական ուսումնական հաստատությունների կազմակերպման համար նախատեսված անշարժ գույքի օտարման արդյունքում հետագայում էականորեն նվազել է համայնքում նախադպրոցական և արտադպրոցական կրթության իրականացումը կազմակերպելու, երեխայի ներդաշնակ ու համակողմանի զարգացման, ուսուցման ու դաստիարակության իրագործման արդյունավետությունը: Այդ կերպ նույնպես էական վնաս է պատճառվել համայնքի, պետության օրինական շահերին՝ առաջացնելով ծանր հետևանքներ։
Փաստի առթիվ մարզի դատախազության դատախազի անմիջական հսկողության ներքո ոստիկանության Թումանյանի բաժնում ՀՀ քրեական օրենսգրքի 314-րդ հոդվածի 1-ին մասի, 214-րդ հոդվածի 2-րդ մասի և 308-րդ հոդվածի 2-րդ մասի հատկանիշներով հարուցվել է քրեական գործ: Նախաքննությունը կատարելու նպատակով քրեական գործն ուղարկվել է Լոռու մարզային քննչական վարչություն:
Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
