ՀՀ նախկին գլխավոր հարկադիր կատարող Միհրան Պողոսյանի խափանման միջոցը նոր չի վերացվել։ Այս մասին այսօր՝ նոյեմբերի 29-ին, լրագրողների հետ զրույցում ասաց Գլխավոր դատախազ Արթուր Դավթյանը։

 

«Երբ երկիրը մերժում է հանձնումը, այլևս 1 վայրկյան չի կարող որևէ մեկին պահել, այսինքն՝ դա նոր բան չի։ Բայց այս առումով մենք շարունակում ենք քննարկումները ՌԴ մեր գործընկերների հետ, և նկատի ունենալով, որ քրգործն էլ ակտիվ փուլում է, չեմ բացառում, որ նոր, ավելի ծանր հանցագործությունների դրվագներ կունենանք այդ առումով, բնականաբար հանցանքի ծանրությամբ պայմանավորված հույս ունենք մեր գործընկերները իրավական և արադարացի մոտեցում կցուցաբարեն»,-նշեց նա։

 

Հարցին՝ բավարար ծանր չէ պողոսյանի մեղադրանքը, մի քանի հոդվածներով է մեղադրվում,  Դավթյանն արձագանքեց․ «Իհարկե ծանր է, իսկ բավարար է, թե ոչ, մենք արդեն ասել ենք, եղած իրավիճակում ունենք այն, ինչ ունենք, իմ ասելիքն այն է, որ քրգործի քննությունը ակտիվ շարունակվում է, նոր դրվագներ պարզաբանվելու դեպքում մենք մեր գործընկերների հետ շփումները շարունակելու ենք, այսինքն՝ նրա արտահանձման խիստ անհրաժեշտությունը ամեն կոնկրետ իրավիճակով շարունակելու ենք հիմնավորել»։

 

Հարցին՝ ինչու է Պողոսյանի արտահանձնումը ՌԴ-ն  մերժելը «Քաղաքացիական, ընտանեկան և քրեական գործերով իրավական օգնության և իրավական հարաբերությունների մասին» 1993թ․ հունվարի 1-ի Կոնվենցիայի 19-րդ հոդվածի համաձայն, արտահանձնումը ինչ վնաս կարող էր պատճառել ՌԴ ինքնիշխանությանը կամ անվտանգությանը, Դավթյանն ասաց․

 

«Նույն հարցերը կան ինձ մոտ և այդ հարցերի պատասխանը փորձում ենք ստանալ մեր գործընկերներից։  Այս նույն գործընթացում կան որոշակի պրոցեդուրաներ, որոնք պետությունները հրապարակելու արգելք ունեն, խոսքը վերաբերում է ապաստանին, միջազգային համապատասխան կոնվենցիաները արգելում են ապաստան տված երկրին կամ երբ անձը դիմում է ապաստանի համար, այդ փաստը հրապարակել։  Թե որքանով է պատճառը դա, մենք փորձում ենք պատճառները ավելի խորը հասկանալ»։

 

Հարցին՝  այսինք չարտահանձնելու որոշումը ընդունելի չէ Դատախազության համար, նա պատասխանեց․ «Եթե ընդունելի լիներ, մենք չէինք շարունակի մեր շփումները»։

 

Հիշեցնենք, որ ՌԴ գլխավոր դատախազությունից ավելի վաղ ստացված տեղեկատվության համաձայն, նախկին պատգամավոր, Դատական ակտերի հարկադիր կատարման ծառայության (ԴԱՀԿ) նախկին պետ Միհրան Պողոսյանին քրեական հետապնդման ենթարկելու նպատակով հանձնելու մասին ՀՀ գլխավոր դատախազության միջնորդության բավարարումը հնարավոր չի համարվել՝ հիմք ընդունելով «Քաղաքացիական, ընտանեկան և քրեական գործերով իրավական օգնության և իրավական հարաբերությունների մասին» 1993 թվականի հունվարի 1-ի Կոնվենցիայի 19-րդ հոդվածի դրույթները:

 

Առանձնապես խոշոր չափերով գույք հափշտակելու և պաշտոնեական դիրքը չարաշահելու մեղադրանքով հետախուզվող Պողոսյանը հայտնաբերվել էր Ռուսաստանում:
