Երևանում 21-ամյա կինը խորտկարանում իր ծննդյան խնջույքի ժամանակ դանակահարել է 58-ամյա տղամարդու

ՀՀ քննչական կոմիտեի Երևան քաղաքի Էրեբունի և Նուբարաշեն վարչական շրջանների քննչական բաժնում ավարտվել է ծննդյան խնջույքի ժամանակ առաջացած վիճաբանության ընթացքում ծանր մարմնական վնասվածք պատճառելու և տուժողի կողմից սուտ մատնություն կատարելու դեպքերի առթիվ հարուցված քրեական գործերի նախաքննությունը:
Այս մասին հայտնում են ՀՀ քննչական կոմիտեի դեպարտամենտի տեղեկատվության և հասարակայնության հետ կապերի բաժնից։
2014 թվականի հուլիսի 6-ին «Էրեբունի» բժշկական կենտրոնից ահազանգ է ստացվել, որ իրենց մոտ է տեղափոխվել 1957 թվականին ծնված Խ. Գրիգորյանը` «որովայնի ձախ կեսի ծակած-կտրած վերք» ախտորոշմամբ։
Դեպքի առթիվ հարուցվել է քրեական գործ՝ ՀՀ քրեական օրենսգրքի 112-րդ հոդվածի 1-ին մասով (ծանր մարմնական վնասի պատճառում):
Նախաքննությամբ ձեռք բերված ապացույցներով պարզվել է, որ տղամարդը ծանր մարմնական վնասվածք է ստացել նույն օրը խորտկարանում տեղի ունեցած խնջույքի ժամանակ։ Խնջույքը կազմակերպվել էր խորտկարանի վարձակալների՝ ամուսիններ Մ. Մուրադյանի և Գ. Մարտիրոսյանի կողմից՝ նշելու վերջինիս ծննդյան 21-րդ տարեդարձը։
Խնջույքի ժամանակ առաջացել է վիճաբանություն, որը վերածվել է ծեծկռտուքի, ինչի ժամանակ էլ Խ. Գրիգորյանին դանակի գործադրմամբ պատճառվել է մարմնական վնասվածք։
Տուժողը նախաքննության ընթացքում ցուցմունք է տվել, որ իրեն մարմնական վնասվածք է պատճառել խորտկարանի վարձակալը՝ Մ. Մուրադյանը, ով ներգրավվել էր որպես կասկածյալ և ձերբակալվել, սակայն քննության ընթացքում բավարար ապացույցներ են ձեռք բերվել, որ իրականում տղամարդուն դանակով հարվածել է Մ. Մուրադյանի կինը, ում ծննդյան տարեդարձը նշում էին խորտկարանում։
Մ. Մուրադյանի նկատմամբ քրեական հետապնդում չի իրականացվել։ Ձեռք բերված ապացույցների հիման վրա կնոջը մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 112-րդ հոդվածի 1-ին մասով։ Քրեական գործը՝ մեղադրական եզրակացությամբ, ուղարկվել է նախաքննության օրինականության նկատմամբ հսկողություն իրականացնող դատախազին։
Նախաքննության ընթացքում տուժողի կողմից Մ. Մուրադյանի նկատմամբ սուտ մատնություն կատարելու վերաբերյալ նյութերի հիման վրա հարուցվել է նոր քրեական գործ, և Խ. Գրիգորյանին մեղադրանք առաջադրվել սուտ մատնության համար՝ ՀՀ քրեական օրենսգրքի 333-րդ հոդվածի 2-րդ մասի 1-ին կետով:
Այս մասով ևս նախաքննությունն ավարտվել է, և քրեական գործը՝ մեղադրական եզրակացությամբ, ուղարկվել նախաքննության օրինականության նկատմամբ հսկողություն իրականացնող դատախազին:
