ՍԴ-ն նախկինում պետությունը զավթածների վերջին բաստիոնն է․ ստեղծված ճգնաժամից դուրս գալու երկու ելք կա
POLITICS«Այն, որ Սահմանադրական Դատարանի նկատմամբ կա հանրային վստահության ճգնաժամ՝ ակնհայտ է և 2018 թվականին Թավշյա հեղափոխություն իրականացնելու պատճառներից մեկն էլ հենց սա էր, որովհետև, եթե Սահմանադրական Դատարանն իր դիրքում լիներ և սահմանադրական կարգը պաշտպանողի դիրքում լիներ, ապա, բնականաբար, նախորդ իշխանությունների կողմից պետության զավթում չէր լինի։ Բոլորս էլ պետք է ընդունեք, որ նման երկրներում, որտեղ պետությունը զավթվում է մի խումբ մարդկանց կողմից, ապա դա նաև դատական իշխանության և հատկապես Սահմանադրական Դատարանի անգործության հետևանք է։
Պատահական չէ, որ պետության այդ զավթիչները հիմա այսպես ատամներով պաշտպանում են ՍԴ-ն կամ դրա իբրև անկախությունը, որովհետև սա նրանց վերջին բաստիոնն է։ Սա հաշվի առնելով՝ կարող ենք ասել, որ ՍԴ-ի շուրջ ճգնաժամը նոր չի առաջացել, այլ վաղուց կա, պարզապես այս փուլում այդ ճգնաժամը խորացել է այն պատճառով, որ ՍԴ-ն չի համապատասխանեցվել ժողովրդավարական և իրավական պետության չափանիշներին»,- «Առաջին լրատվական»-ի հետ զրույցում նշեց իրավապաշտպան Արթուր Սաքունցը՝ անդրադառնալով Սահմանադրական Դատարանի շուրջ ստեղծված իրավիճակին։
Իրավապաշտպանի գնահատմամբ՝ ստեղծված իրավիճակից իրավական ճանապարհով դուրս գալու երկու ելք կա։
«Առաջինը՝ ներկայիս Սահմանադրության փոփոխությունն է և նոր Սահմանադրության ընդունումը, քանի որ սա խորհրդարանական կառավարման մոդելով շարժվող երկրի Սահմանադրություն չի և չի ապահովում իշխանությունների տարանջատման և փոխզսպման սկզբունքը։
Երկրորդ՝ ՍԴ անդամներն իրենք պետք է քաղաքացիական պատասխանատվություն զգան ու ինքնակամ հրաժարական ներկայացնեն։ Բայց այս համատեքստում ուզում եմ մի կարևորագույն խնդիր մատնանշել՝ հիմա մենք ունենք մի այնպիսի ՍԴ, որ, եթե անգամ դրա բոլոր ներկայիս անդամները հրաժարական էլ տան, ապա ՍԴ-ի նկատմամբ վերաբերմունքը չի կարող փոխվել, քանզի այն մեխանիզմները, որով աշխատում է ՍԴ-ն՝ վստահելի համարվել, միանշանակ, չի կարող։ Պետք է հստակ ինստիտուցիոնալ մակարդակով ամրագրել Սահմանադրական Դատարանի անկախությունը»,-շեշտեց մեր զրուցակիցը։
