ՀՀ կառավարության հոկտեմբերի 10-ի նիստում ընդունել է գնումների գործընթացի արդյունավետությունը բարձրացնելուն ուղղված կարգավորումների մասին որոշում, որի մեջ ներառված են նաև Մարդու իրավունքների պաշտպանի առաջարկները։

Մասնավորապես, Մարդու իրավունքների պաշտպանի առաջարկներն ուղարկվել էին Վարչապետի աշխատակազմ, ապա Վարչապետի հանձնարարությամբ Ֆինանսների նախարարությունը մշակել էր կառավարության որոշման նախագիծը՝ անհրաժեշտ կարգավորումներով։ Պաշտպանը կարևոր է համարում Կառավարության հետ համագործակցության նման ձևաչափը:

Մարդու իրավունքների պաշտպանի առաջարկությամբ ամրագրվել է, որ գնումների գործընթացում հայտերի բացման նիստի ընթացքում իրականացված գնահատման արդյունքում մասնակցի հայտում անհամապատասխանություններ արձանագրվելու պարագայում մասնակցին այդ մասին տեղեկացնելիս հստակ նշել, թե կոնկրետ որ հարցին է վերաբերում անհամապատասխանությունը։ Այսուհետ գնումների գործընթացում մասնակցի հայտում անհամապատասխանություններ արձանագրվելու դեպքում հանձնաժողովի քարտուղարը նույն օրը դրա մասին էլեկտրոնային եղանակով ծանուցելու է մասնակցին՝ առաջարկելով մինչև կասեցման ժամկետի ավարտը շտկել անհամապատասխանությունը՝ մասնակցին ուղարկվող ծանուցման մեջ մանրամասն նկարագրելով հայտնաբերված անհամապատասխանությունները:

Հիշեցնենք, որ Մարդու իրավունքների պաշտպանի աշխատակազմը նախագիծը մշակել էր հաշվի առնելով հասցեագրված բողոքները։ Մասնավորապես, գործարար կազմակերպություններից մեկի ղեկավարը, համաձայն չլինելով պետական կարիքների համար կազմակերպված հրատապ բաց մրցույթին մասնակցած մրցույթի արդյունքներին, դիմել էր պետական գնումների բողոքները քննող անձին՝ միաժամանակ ներկայացնելով միջնորդություն Մարդու իրավունքների պաշպանին՝ բողոքի քննությանը որպես կողմ ներգրավելու համար։

 

Գործարարների իրավունքների արդյունավետ պաշտպանության երաշխավորման նպատակով Պաշտպանի ներկայացուցիչը որպես կողմ մասնակցել էր գնումների հետ կապված բողոքի քննությանը։ Արդյունքում, բավարարվել էր պետական գնումներին մասնակցած գործարարի բողոքը։

Մարդու իրավունքների պաշտպանի դիտարկմամբ՝ ընդունված փոփոխությունները կապահովվեն գնումների կազմակերպման գործընթացում պետական մարմինների կողմից որոշակիության և հստակության սկզբունքների պահպանումը։
