ԱԺ հանձնաժողովը չընդունեց զոհված զինծառայողի ընտանիքի անդամներին տրվող օգնությանն առնչվող նախագիծը

ՀՀ ազգային ժողովի պաշտպանության և անվտանգության հարցերի մշտական հանձնաժողովը բացասական եզրակացություն տվեց «Լուսավոր Հայաստան» խմբակցության պատգամավոր Գևորգ Գորգիսյանի՝ զոհված զինծառայողների ընտանիքի անդամներին տրվող դրական օգնության վերաբերյալ նախագծին: «Զինվորական ծառայության և զինծառայողի կարգավիճակի մասին» ՀՀ օրենքում լրացում կատարելու մասին օրենքի նախագիծը քննարկվեց հանձնաժողովի հոկտեմբերի 17-ի նիստում:

«Զինծառայության ընթացքում զոհված զինծառայողի ընտանիքի անդամներին սահմանված դեպքում տարվա ընթացքում կարող է վճարվել միանվագ դրամական օգնություն՝ ՀՀ կառավարության սահմանված չափով:  Ըստ օրենսգրքի համապատասխան մասի՝ զինծառայողի ընտանիքի անդամ են համարվում ամուսինը, զավակները և ծնողները:  Առաջարկում ենք, որ եթե հետագայում դատական կարգով կամ նոտարի միջոցով հաստատվի  ազգակցական կապը՝ ամուսին կամ զավակ լինելու հանգամանքը, նույնպես կիրառվի նման միջոց: Եթե համապատասխան պետական մարմնում գրանցված չի եղել ամուսնությունը, բայց փաստացի ամուսիններ են և դա որևէ կերպ հաստատվել  է նոտարով կամ դատարանով, ապա նույն գումարը կտրամադրվի քաղաքացիներին»,-ասաց Գորգիսյանն ու հավելեց՝ նույնը ծնող և զավակ հարաբերությունների դեպքում:

ՀՀ պաշտպանության նախարարի տեղակալ Գաբրիել Բալայանը ներկայացրեց կառավարության տեսակետը: Նա նշեց, որ այս կարգավորումը կհակասի ավելի բարձր իրավական ուժ ունեցող Ընտանեկան օրենսգրքին։ Կառավարությունը գտել է, որ փոփոխության անհրաժեշտություն չկա: Բալայանը նկատեց, որ փոփոխությունը կլինի հակաիրավական:

 

Նախագիծը հանձնաժողովում քվեարկությամբ ստացավ բացասական եզրակացություն:
