Արմավիրի մարզի ընդհանուր իրավասության դատարանը համաներումով կարճել է Մեծամոր քաղաքում մահացած նորածնին աղբամանը նետած 38-ամյա կնոջ գործը: Այս մասին տեղեկանում ենք «Դատալեքս» տեղեկատվական համակարգից:

 

Նշենք, որ կնոջը մեղադրանք էր առաջադրվել ՀՀ Քրեական օրենսգրքի 106 հոդվածով:

 

 

Նախաքննական մարմինը պարզել էր, որ 38-ամյա կինը հղիացել էր 2017թ. ամռանը ինքնությունը չպարզված անձից: Ընտանիքի սոցիալական ծանր վիճակի և արդեն իսկ ունեցած 4 երեխաներին պահելու միջոցներ չունենալու պատճառով հղիությունը, ինչպես նաև երեխայի ծնունդը եղել է անցանկալի։ Այդ պատճառով հղիության ընթացքում որևէ բժշկական կենտրոնի կանանց կոնսուլտացիա 38-ամյա կինը չի դիմել, որևէ բուժօգնություն չի ստացել և որոշել է երեխային ծննդաբերել տան պայմաններում։ Կինը երեխան ունեցել է 2018թ.-ի փետրվարին տան լոգարանում, ծննդաբերության ժամանակ նորածինն ընկել է լոգարանի սալիկապատ հատակին և մահացել: Մայրն այնուհետեւ երեխայի դին դրել է պոլիէթիլենային տոպրակի մեջ և նույն օրը գցել  Մեծամորի շենքերից մեկի աղբամանի մեջ։

 

Դատական նիստում ամբաստանյալը միջնորդել է Համաներման Օրենքի 2-րդ հոդվածի 5-րդ մասի 2-րդ ենթակետի ուժով քրեական հետապնդումը դադարեցնել և քրեական գործի վարույթը կարճել։

 

Գործով դատախազը չի առարկել, դատարանն էլ Վահե Խալաթյանի նախագահությամբ կարճել է քրգործը եւ դադարեցրել քրեական հետապնդումը:
