Էլեկտրաէներգիայի թանկացման դեմ երթը Ոստիկանությունը համարում է անօրինական

Հայաստանի Հանրապետության ոստիկանությունը էլեկտրաէներգիայի թանկացման դեմ կազմակեպված երթը դեպի ՀՀ Նախագահի նստավայր համարում է անօրինական: Այս մասին նշված է ՀՀ ոստիկանության կողմից հրապարկված հայտարարությունում:
Ինչպես տեղեկացրին ՀՀ ոստիկանության հասարակայնության հետ կապերի և լրատվության վարչությունից, ՀՀ ոստիկանության պաշտոնական հաղորդագրությումում, մասնավորապես, ասված է .«Չնայած ոստիկանության բազմաթիվ զգուշացումներին, կազմակերպիչնե րը ոստիկանության օրինական պահանջներին չեն ենթարկվում: Ոստիկանությունը պարզաբանում է. «Ոստիկանության մասին» Հայաստանի Հանրապետության օրենքի 2-րդ հոդվածի համաձայն՝ ոստիկանության խնդիրներից է օրենքին համապատասխան ապահովել վարչական իրավախախտումների նախականխումը, կանխումը և խափանումը:
Նույն օրենքի 11-րդ հոդվածի 1-ին կետի համաձայն՝ ոստիկանությունը պարտավոր է բերման ենթարկել հանցանք կամ վարույթ պահանջող այլ իրավախախտում կատարած անձանց, պարզել հանցագործություններ և այլ իրավախախտումներ ծնող պատճառներն ու դրանց նպաստող պայմանները , ձեռնարկել համապատասխան միջոցներ դրանք վերացնելու ուղղությամբ:
«Վարչական իրավախախտումների վերաբերյալ» ՀՀ օրենսգիրքը վարչական պատասխանատվություն է սահմանել առանց համայնքի ղեկավարին օրենքով սահմանված կարգով իրազեկելու կամ իրազեկման պայմանների խախտմամբ հավաք անցկացնելու համար /հոդված 1801, մաս 1-ին/, որի նախականխումը, կանխումը, ինչպես նաև ապօրինի երթի խափանումը /հատկապես երբ իրավախախտումը տևող բնույթ ունի/ ոստիկանությունը ապահովելու է ապօրինի երթի կազմակերպիչների նկատմամբ վարչական հարկադրանքի միջոցներ կիրառելով»:
Ոստիկանության հաղորդագրությունում նշվում է, որ երթի մասնակիցների կողմից ոստիկանության ծառայողների օրինական պահանջներին չենթարկվելու կամ դիմադրություն ցույց տալու դեպքերում երթը այլևս չի համարվի խաղաղ և օրենքով սահմանված կարգով կդադարեցվի: «Ոստիկանությունը զգուշացնում է, որ իր լիազորությունների իրականացման ընթացքում իրավասու է իրավախախտների նկատմամբ կիրառել ֆիզիկական ուժ և հատուկ միջոցներ»,- նշվում է հայտարարությունում:
