Տիրազուրկ գույք. ի՞նչ է այն, ե՞րբ ու ի՞նչ կարգով է գույքը ճանաչվում տիրազուրկ
SOCIETY«Փաստ» օրաթերթը շարունակում է ներկայացնել «Ճանաչեք և պաշտպանեք ձեր իրավունքները» խորագիրը: Շատ են դեպքերը, երբ քաղաքացիները չեն կարողանում պաշտպանել իրենց իրավունքները, քանի որ իրազեկված չեն, իսկ երբեմն էլ որոշ պետական հիմնարկներ էլ ավելի են շփոթեցնում նրանց:
Օրաթերթը, համագործակցելով ՀՀ փաստաբանների պալատի հետ, այսուհետ հանրային իրազեկման արշավ է կազմակերպում, որը կօգնի մեր քաղաքացիներին իմանալ և պաշտպանել իրենց իրավունքները: Նշենք նաև, որ յուրաքանչյուր հինգշաբթի՝ ժամը 10:00-ից մինչև 17:00-ն փաստաբանների պալատի հանրային պաշտպանի գրասենյակն անվճար խորհրդատվություն է տրամադրում ՀՀ բոլոր քաղաքացիներին:
Հարց. - Ո՞րն է տիրազուրկ գույքը, ի՞նչ կարգով է գույքը ճանաչվում տիրազուրկ:
Պատասխանում է փաստաբան Էդգար Գրիգորյանը:
-Տիրազուրկ է համարվում այն գույքը, որը չունի սեփականատեր, կամ որի սեփականատերն անհայտ է կամ հրաժարվել է դրա նկատմամբ սեփականության իրավունքից: Տիրազուրկ անշարժ գույքի նկատմամբ սեփականության իրավունքը կարող է ձեռք բերվել ձեռքբերման վաղեմության ուժով:
Սակայն սույն նորմը չի կիրառվում ինքնակամ կառույց հանդիսացող անշարժ գույքի նկատմամբ:
Քաղաքացին կամ իրավաբանական անձը, որն անշարժ գույքի սեփականատեր չէ, սակայն այն տասը տարվա ընթացքում բարեխղճորեն, բացահայտ և անընդմեջ տիրապետում է որպես սեփական գույք, այդ գույքի նկատմամբ ձեռք է բերում սեփականության իրավունք (ձեռքբերման վաղեմություն):
Տիրազուրկ շարժական գույքի նկատմամբ սեփականության իրավունքը կարող է ձեռք բերվել օրենքով սահմանված կարգով:
Շարժական գույքը, որը սեփականատերը լքել է կամ դրա նկատմամբ սեփականության իրավունքից հրաժարվելու նպատակով թողել է այլ կերպ (դեն նետված գույք), այլ անձինք կարող են վերածել իրենց սեփականության:
Այսինքն, շարժական գույքը տիրազուրկ ճանաչելու համար դատարանում պետք է հիմնավորվի սեփականատիրոջ կողմից այդ գույքը դեն նետելը:
Դեն նետված այլ գույքն անցնում է այն տիրապետող անձի սեփականությանը, եթե այդ անձի դիմումի հիման վրա դատարանը գույքը ճանաչում է տիրազուրկ:
Շարժական գույքը տիրազուրկ ճանաչելու վերաբերյալ դիմումը տրվում է գույքը տիրապետող քաղաքացու բնակության վայրի կամ իրավաբանական անձի գտնվելու վայրի ընդհանուր իրավասության դատարան:
Անշարժ գույքը տիրազուրկ ճանաչելու վերաբերյալ դիմումը տրվում է այդ գույքի գտնվելու վայրի ընդհանուր իրավասության դատարան:
Գույքը տիրազուրկ ճանաչելու վերաբերյալ քաղաքացու կամ իրավաբանական անձի դիմումում պետք է նշվի, թե որ գույքն է տիրազուրկ ճանաչվելու, նկարագրվեն դրա հիմնական տարբերակիչ հատկանիշները, ինչպես նաև բերվեն ապացույցներ, որոնք հաստատում են սեփականատիրոջ կողմից առանց գույքի նկատմամբ սեփականության իրավունքը պահպանելու մտադրության գույքը թողնելու փաստը և ապացույցներ` գույքը դիմողի տիրապետմանն անցնելու մասին:
Դատարանը, գտնելով, որ գույքը սեփականատեր չունի կամ այն դրա սեփականատիրոջ կողմից թողնվել է առանց դրա նկատմամբ սեփականության իրավունքը պահպանելու մտադրության, վճիռ է կայացնում գույքը տիրազուրկ ճանաչելու և տիրապետող անձի սեփականությանն այն հանձնելու մասին:
