Ոստիկանության օպերլիազորը թաքցրել էր հանցագործությունը

ՀՀ հատուկ քննչական ծառայությունում քննվող քրեական գործի նախաքննությամբ հիմնավորվել է, որ ՀՀ ոստիկանության Երեւան քաղաքի վարչության Մաշտոցի բաժնի ավագ օպերլիազոր, ոստիկանության մայոր Կոնստանտին Հայրապետյանը, անձնական այլ շահագրգռվածությունից ելնելով, դիտավորությամբ չի կատարել իր ծառայողական պարտականությունները եւ ծանր հանցագործության դեպքը թաքցրել է հաշվառումից:
Մասնավորապես՝ Կ. Հայրապետյանը իր ծանոթ Հարություն Պ.-ից բանավոր տեղեկություններ է ստացել անհայտ անձի կողմից նրա վարձակալած բնակարանից կատարված գողության եւ դրանում վերջինիս ընկերոջ դուստր Սրբուհի Հ.-ի առնչություն ունենալու կասկածի մասին: Այնուհետեւ Հարություն Պ.-ն խնդրել է առանց հանցագործության մասին հաղորդում ներկայացնելու փորձել պարզել կատարվածի մեջ Սրբուհի Հ.-ի առնչությունը:
Ընկերոջ խնդրանքը չմերժելու, ինչպես նաեւ հանցագործությունների բացահայտման բացասական ցուցանիշ չարձանագրելու անձնական այլ շահագրգռվածությունից ելնելով, ոստիկանության աշխատակիցը Հարություն Պ.-ից հանցագործության մասին հաղորդում վերցնելու վերաբերյալ գրավոր արձանագրություն չի կազմել, նրա հայտնած՝ հանցագործության դեպքի մասին տեղեկությունը չի հաշվառել, քննիչին եւ դատախազին հայտնաբերված ծանր հանցագործության մասին տեղյակ չի պահել, դեպքի վայրը չի զննել եւ ձեռնամուխ չի եղել հանցագործության հետքերի հայտնաբերման եւ հանցագործություն կատարած անձի բացահայտման միջոցառումների կատարմանը: Այս կերպ՝ Հարություն Պ.-ի մոտ հանցագործության բացահայտման միջոցառումների պատրանք ստեղծելու նպատակով, վերջինիս հայտնած բանավոր կասկածի հիման վրա, ավագ օպերլիազորը 3-4 անգամ անօրինական բաժին է հրավիրել Սրբուհի Հ.-ին: Վերջինիս հետ յուրաքանչյուր անգամ դեպքի հանգամանքների շուրջ զրուցել է, սակայն համապատասխան արձանագրություն չի կազմել:
Հիշեցնենք, որ ՀՀ հատուկ քննչական ծառայությունում քննվող քրեական գործով ՀՀ ոստիկանության աշխատակից Կ. Հայրապետյանին մեղադրանք էր առաջադրվել ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի 1-ին մասով:
ՀՀ հատուկ քննչական ծառայությունում ավարտվել է ՀՀ ոստիկանության Երեւան քաղաքի վարչության Մաշտոցի բաժնի ավագ օպերլիազոր, ոստիկանության մայոր Կոնստանտին Հայրապետյանի կողմից պաշտոնեական լիազորությունները չարաշահելու դեպքի առթիվ հարուցված քրեական գործի նախաքննությունը եւ հիշյալ գործը մեղադրական եզրակացությամբ հանձնվել է դատավարական հսկողություն իրականացնող դատախազին՝ այն հաստատելու եւ դատարան ուղարկելու համար:
