SOCIETY«Փաստ» օրաթերթը շարունակում է ներկայացնել «Ճանաչեք և պաշտպանեք ձեր իրավունքները» խորագիրը: Շատ են դեպքերը, երբ քաղաքացիները չեն կարողանում պաշտպանել իրենց իրավունքները, քանի որ իրազեկված չեն, իսկ երբեմն էլ որոշ պետական հիմնարկներ էլ ավելի են շփոթեցնում նրանց:
Օրաթերթը, համագործակցելով ՀՀ փաստաբանների պալատի հետ, այսուհետ հանրային իրազեկման արշավ է կազմակերպում, որը կօգնի մեր քաղաքացիներին իմանալ և պաշտպանել իրենց իրավունքները: Նշենք նաև, որ յուրաքանչյուր հինգշաբթի՝ ժամը 10:00-ից մինչև 17:00-ն փաստաբանների պալատի հանրային պաշտպանի գրասենյակն անվճար խորհրդատվություն է տրամադրում ՀՀ բոլոր քաղաքացիներին:

Հարց.-Մեկուկես տարի է՝ պարտքով գումար եմ տվել մի անձնավորության և չեմ կարողանում հետ ստանալ, դրա դիմաց վերցրել եմ զինվորական գրքույկը և պարտավորագիր, որտեղ նշված է պարտքի չափը և ժամկետը։ Նշված ժամկետից անցել է 1 տարի։ Ի՞նչ կարող եմ անել:

Քաղաքացիների միջև ծագել են փոխառության, հետևաբար նաև պարտավորական իրավահարաբերություններ, որոնք կարգավորվում են ՀՀ քաղաքացիական օրենսգրքի համապատասխան նորմերով:
Գումարը հանձնելու պահից կնքվել է փոխառության պայմանագիր, որի փաստը հավաստվում է պարտապանի կողմից տրված գրավոր պարտավորագրով:
Նկարագրված դեպքում, եթե պարտավորագրում նշված ժամկետի ավարտից հետո արդեն իսկ անցել է 1 տարի և պարտապանը չի վերադարձնում գումարը, ապա պարտատերն իրավունք ունի նրա դեմ հայց հարուցել՝ գումարի բռնագանձման պահանջով, ինչպես նաև պահանջել վճարելու օրենքով նախատեսված տոկոսները:
Ինչ վերաբերում է պարտապանից զինվորական գրքույկը վերցնելուն, ապա այդ գործողությունը պարտավորությունների կատարման ապահովում չի կարող դիտվել, այսինքն՝ իրավական տեսանկյունից այդ փաստը որևէ խնդիր չի լուծում:
Հիշեցնենք նաև, որ հայցային վաղեմության ընդհանուր ժամկետը երեք տարի է, իսկ հայցային վաղեմություն է համարվում իրավունքը խախտված անձի հայցով իրավունքի պաշտպանության ժամանակահատվածը:
Այն պարտավորությունների համար, որոնք կատարելու համար որոշված է որոշակի ժամկետ, հայցային վաղեմության ընթացքն սկսվում է այդ ժամկետի ավարտմամբ:
Այս պարագայում, պարտավորագրում նշված ժամկետի ավարտմամբ /դեռևս մեկ տարի առաջ/ սկսվել է պարտատիրոջ խախտված իրավունքի պաշտպանության հայցային վաղեմության ժամկետի ընթացքը, հետևաբար վերջինս ունի երկու տարի՝ դատարան դիմել համար:
