Գագիկ Ջհանգիրյանը քիչ առաջ արդարացվեց. վճռաբեկ դատարանը հրապարակեց որոշումը

Վճռաբեկ դատարանը բավարարել է ՀՀ գլխավոր դատախազի նախկին տեղակալ Գագիկ Ջհանգիրյանի բողոքը, որով նա պահանջել էր բեկանել տարիներ առաջ իր նկատմամբ կայացված մեղադրական դատավճիռը եւ արդարացնել։ Այս մասին հաղորդում է «Փաստինֆո»-ն։

 

Ավելի վաղ տեղեկացրել ենք, որ 2019 թվականի հուլիսի 16-ին Գ.Ջհանիգիրյանը վճռաբեկ բողոք է ներկայացրել շուրջ 10 տարի առաջ կայացված դատական ակտի դեմ, որով ինքը մեղավոր էր ճանաչվել ոստիկանների նկատմամբ բռնություն գործադրելու համար՝ ՀՀ քրեական օրենսգրքի 316-րդ հոդվածի 1-ին մասով ու դատապարտվել 3 տարվա ազատազրկման։

 

 

Հիշեցնենք, ըստ դատավճռի՝ Ջհանգիրյանը 2008թ.-ին ՀՀ Ոստիկանության ԿՀԴՊ Գլխավոր վարչության վարչական շենք մտնելու պահին չենթարկվելով ոստիկանության աշխատակիցներին, ձեռքով հարվածել էր վարչության աշխատակցին՝ պատճառելով ֆիզիկական ցավ, նաև պատռել մեկ այլ աշխատակցի համազգեստը:

 

Սա այս գործով երկրորդ վճռաբեկ բողոքն է, որը ներկայացվել էր Ջհանգիրյանի կողմից։ Առաջին անգամ այն վերին դատական ատյան բողոքարկվել էր նույն 2009 թվականին, սակայն այն ժամանակ Վճռաբեկ դատարանը բողոքը վարույթ չէր ընդունել ու վերադարձրել էր։

 

10 տարի անց ներկայացված բողոքը նախ մակագրվել էր Վճռաբեկ դատարանի քրեական պալատի նախագահ Լիլիթ Թադեւոսյանին, որը սակայն ինքնաբացարկ է հայտնել եւ գործով զեկուցող է նշանակվել դատավոր Արթուր Պողոսյանը։

 

Նշենք, որ մամուլում վերջին շրջանում խոսվում էր նրա՝ գլխավոր դատախազ հնարավոր նշանակման մասին։ Սակայն նրա պաշտոն ստանալու հարցում առկա է օրենսդրական արգելք։

 

Դատախազ նշանակվելու կարգը սահմանված է «Դատախազության մասին» ՀՀ օրենքով, որի 34-րդ հոդվածը թվարկում է սահմանափակումները։

 

Ըստ այդմ՝ դատախազ չի կարող նշանակվել այն անձը, որը դատապարտվել է դիտավորյալ հանցագործության համար` անկախ դատվածությունը մարված կամ հանված լինելու հանգամանքից, իսկ անզգույշ հանցագործության դեպքում՝ մինչև դատվածությունը չի մարվել կամ հանվել։

 

Վճռաբեկ դատարանի այսօրվա որոշումից հետո Գագիկ Ջհանգիրյանը կարող է հավակնել պաշտոնի։
