BLOGԵս ճի՞շտ եմ հասկանում, որ ԱԺ խմբակցություններից մեկը ՍԴ նախագահի լիազորությունների դադարեցման գործընթաց է ուզում սկսել այն բանի համար, որ ՍԴ-ն չի խախտել օրենքը: Այս մասին Facebook-ի իր էջում գրել է ՀՀ արդարադատության նախարարի նախկին առաջին տեղակալ Արթուր Հովհաննիսյանը:
Նա, մասնավորապես, նշել է.
«1․«Սահմանադրական դատարանի մասին» ՀՀ սահմանադրական օրենքի 16-րդ հոդվածի 4-րդ մասի համաձայն՝ Սահմանադրական դատարանի դատավորի` գործի քննությանը մասնակցելու անհնարինության հարցը Սահմանադրական դատարանը լուծում է գործը քննության ընդունելու մասին աշխատակարգային որոշման շրջանակներում: Հայտնի գործով աշխատակարգային որոշումը ընդունվել է 21․06․2019թ․, իսկ Վ․ Գրիգորյանը իր միջնորդությունը ներկայացրել է 02․09․2019թ․-ին:
Ես ճի՞շտ եմ հասկանում, որ ԱԺ խմբակցություններից մեկը ՍԴ նախագահի լիազորությունների դադարեցման գործընթաց է ուզում սկսել այն բանի համար, որ ՍԴ-ն չի խախտել օրենքը, այլ, ընդհակառակը, հստակ առաջնորդվել է օրենքի 16-րդ հոդվածի 4-րդ մասով:
2․ Եթե շարժվենք Վ․ Գրիգորյանի միջնորդության տրամաբանությամբ, ուրեմն ՍԴ Նախագահի լիազորությունների դադարեցման հարցը ՍԴ-ում հնարավոր չի լինելու քննության առնել, քանի որ անհրաժեշտ է 6 դատավորի ձայն, մինչդեռ Հ․ Թովմասյանը չի կարող մասնակցել իր վերաբերյալ գործին, Վ․ Գրիգորյանը ևս չի կարող մասնակցել, քանի որ կանխակալ է, Արևիկ Պետրոսյանը և Հրանտ Նազարյանը ևս չեն կարողանալու մասնակցել, քանի որ նրանք ևս ներառված էին Վ․ Գրիգորյանի միջնորդության մեջ, որը քննության առարկա չէր դարձվել: Այսինքն՝ մնաց 5 դատավոր:
3․ Սահմանադրական դատարանի մասին ՍԴ օրենքի 33-րդ հոդվածը սահմանում է կոլեգիալության սկզբունքը, ՍԴ-ն գործը քննում և որոշում է կայացնում կոլեգիալ, ուստի պասիվ վարքագիծն էլ է կոլեգիալ դրսևորվում, բայց դե ԱԺ խմբակցությունը միայն մե՞կ «մեղավոր» ունի: Արջը յոթ երգ գիտի, յոթն էլ մեղրի մասին…»:
