ՍԴ որոշումը չի կարող գործադրվել, քանի որ այն չի կայացրել անկախ մարմինը. Տիգրան Եգորյան
POLITICSՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանին անհապաղ ազատ արձակելու պաշտպանական կողմի միջնորդության վերաբերյալ դիրքորոշում հայտնեցին տուժողների իրավահաջորդներն ու նրանց ներկայացուցիչները։ Տուժողների իրավահաջորդների ներկայացուցիչներից փաստաբան Տիգրան Եգորյանը հայտարարեց, որ Քոչարյանի դիմումի հիման վրա սեպտեմբերի 4–ին կայացված ՍԴ որոշումը չի հանդիսանում անկախ և անկողմնակալ դատարանի ստանդարտին համապատասխանող դատական ակտ և չի կարող գործադրվել։
Նա նշեց, որ գործի քննության ընթացքում ՍԴ–ն անտեսել է իր և ՍԴ դատավոր Վահե Գրիգորյանի կողմից ներկայացված` Քոչարյանի դիմումի քննությանը ՍԴ անդամների մասնակցության անհնարինության վերաբերյալ միջնորդությունը։
Հիշեցնենք, որ Վահե Գրիգորյանը միջնորդություն էր ներկայացրել ՍԴ–ին գործով զեկուցողներ նշանակված Հրայր Թովմասյանի, Արևիկ Պետրոսյանի և Հրանտ Նազարյանի մասնակցության անհնարինության վերաբերյալ:
Գրիգորյանի հիմնավորմամբ՝ նրանք այս կամ այն կերպ առնչվել են մարտյան դեպքերի վերաբերյալ որոշումների ընդունմանը և չեն կարող անաչառ լինել Քոչարյանի անձեռնմխելիության հարցի վերաբերյալ դիմումը քննելիս:
Ավելի վաղ հայտնել ենք, որ սեպտեմբերի 4–ին ՍԴ–ն մասնակի բավարարեց ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանի դիմումը։ Բարձր դատարանը արձանագրեց, որ 35-րդ հոդվածի 2–րդ մասում նշված քրեական հետապնդումը բացառող հանգամանքների թվում անձեռնմխելիությանը վերաբերող կարգավորում առկա չէ, ինչը հակասահմանադրական է։ Այս որոշումից հետո Քոչարյանի պաշտպանները միջնորդեցին առաջին ատյանի դատարանին՝ ՍԴ որոշման հիմքով անհապաղ ազատ արձակել երկրորդ նախագահին։
