Քոչարյանի մեղադրանքը չի առնչվում նրա գործառութային անձեռնմխելիությանը. դատախազ
POLITICSՍահմանադրական դատարանի որոշման ուժով Ռոբերտ Քոչարյանին ազատ արձակելու հիմքեր չկան։ Այս մասին այսօր՝ սեպտեմբերի 12–ին Երևանի ընդհանուր իրավասության դատարանի Շենգավիթի նստավայրում հայտարարեց Քոչարյանի և մյուսների գործով մեղադրող, Երևան քաղաքի դատախազ Գևորգ Բաղդասարյանը՝ միջնորդելով դատարանին մերժել պաշտպանական կողմի՝ Քոչարյանին անհապաղ ազատ արձակելու միջնորդությունը։
Գևորգ Բաղդասարյանի խոսքով՝ պաշտպանական կողմի միջնորդությունը, համաձայն որի, պետք է Ռոբերտ Քոչարյանին անհապաղ ազատ արձակել կալանքից, չի բխում Սահմանադրական դատարանի որոշման տրամաբանությունից։
Դատախազը, անդրադառնալով պաշտոնաթող նախագահի գործառության անձեռնմխելիության վերաբերյալ առկա իրավակարգավորումներին, նշեց, որ Սահմանադրական դատարանն ընդամենը փաստել է, որ սահմանված չէ հատուկ ընթացակարգ, որի շրջանակներում ինքնուրույն եւ առանձին քննարկման առարկա պետք է դառնա եւ որոշվի այն հարցը, թե արդյոք մեղսագրվող գործողությունները կապված են նախագահի կարգավիճակի հետ։
Այսինքն ըստ մեղադրողի՝ պաշտոնաթող նախագահի գործառութային անձեռնմխելիության առկայության հարցը պետք է գնահատվի եւ լուծվի քրեադատավարական ընդհանուր կարգավորումների շրջանակներում՝ մինչդատական վարույթում քննիչի կամ դատախազի, իսկ դատական վարույթներում՝ դատարանի կողմից։
«Այս գործով քննիչները, դատախազները, դատարանները բազմիցս անդրադարձել են պաշտոնաթող նախագահի անձեռնմխելիության հարցին և դրան տվել համապատասխան գնահատական։ Պաշտոնաթող նախագահին չեն մեղսագրվում գործողություններ, որոնք բխում են նրա կարգավիճակից։ Ռոբերտ Քոչարյանին առաջադրված մեղադրանքը չի առնչվում նրա գործառութային անձեռնմխելիությանը, այսինքն նրան մեղսագրվող արարքները չեն կարող դիտվել որպես նախագահի կարգավիճակից բխող, հետևաբար ՍԴ որոշման ուժով Քոչարյանին ազատ արձակելու հիմքեր առկա չեն»,– ասաց նա։
Ավելի վաղ հայտնել ենք, որ սեպտեմբերի 4–ին ՍԴ–ն մասնակի բավարարեց ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանի դիմումը։ Բարձր դատարանը արձանագրեց, որ Քրեական դատավարության օրենսգրքի 35-րդ հոդվածի 2–րդ մասում նշված քրեական հետապնդումը բացառող հանգամանքների թվում անձեռնմխելիությանը վերաբերող կարգավորում առկա չէ, ինչը հակասահմանադրական է։ Այս որոշումից հետո Քոչարյանի պաշտպանները միջնորդեցին առաջին ատյանի դատարանին՝ ՍԴ որոշման հիմքով անհապաղ ազատ արձակել երկրորդ նախագահին։
