Դատարանը պետք է անհապաղ նիստ հրավիրի եւ Քոչարյանին ազատ արձակի. 2-րդ նախագահի աջակիցները բողոքի ակցիան (ուղիղ)
POLITICSՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանի աջակիցները բողոքի ակցիա են անցկացնում Երեւանի ընդհանուր իրավասության դատարանի Կենտրոն եւ Նորք Մարաշ նստավայրի մոտ` պահանջելով դատարանից անհապաղ ի կատար ածել ՍԴ որոշումը եւ ազատ արձակել երկրորդ նախագահին:
Ակցիայի մանսակիցներից փաստաբան Վահե Եփրիկյանը կարծում է, որ առաջին ատյանի դատարանը պետք է անհապաղ դատական նիստ հրավիրի եւ առաջնահերթության կարգով քննարկի նախագահ Քոչարյանի խափանման միջոցի հարցը:
«Ընդհանուր առմամբ այսօրվա ակցիայի ամբողջ տրամաբանությունն ու իմաստն այն է, որ սույն թվականի սեպտեմբերի 3-ին Սահմանադրական դատարանը որոշում կայացրեց, որով ըստ էության Քրեական դատավարության օրենսգրքի 35-րդ հոդվածի համապատասխան հոդվածը ճանաչեց Սահմանադրությանը հակասող, որից անմիջականորեն բխում է, որ նախագահ Քոչարյանի նկատմամբ քրեական հետապնդումն անթույլատրելի է, իսկ խափանման միջոցի հարցը, բնականաբար եւս: Նման պայմաններում ելնելով մարդու իրավունենքների Եվրոպական կոնվենցիայի, ինչպես նաեւ ներպետական օրենսդրությունից, նաեւ Վճռաբեկ դատարանի նախադեպային իրավունքից կարելի է փաստել հետեյալը, որ քանի որ անձի անազատության հետ կապված հարցերը քննվում են անհապաղության սկզբունքով, ուստի առաջին ատյանի դատարանը տվյալ պարագայում Աննա Դանիբեկյանի նախագահությամբ պետք է անհապաղ դատական նիստ հրավիրի, ինչպես նաեւ առաջնահերթության կարգով քննարկի նախագահ Քոչարյանի խափանման միջոցի հարցը եւ կասկած չկա, որ պետք է վերջինիս ազատ արձակի»,-ասաց նա` հավելելով, որ այս պահի դրությամբ որեւէ գործողություն այդ առումով չի իրականացվում, չնայած որ ՍԴ որոշումից մի քանի օր է անցել:
Վահե Եփրիկյանը նշեց, որ իրենց բողոքի ակցիան խաղաղ բնույթ է կրում եւ պարզապես ցանկանում են պատկան մարմինների ուշադրությունը հրավիրեն իրենց կողմից բարձրացված հարցին եւ կարծում են, որ պետք է իրենց պահանջին օրինական լուծում տան:
Հիշեցնենք, որ սեպտեմբերի 4–ին ՍԴ–ն մասնակի բավարարեց ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանի դիմումը։ Բարձր դատարանը ՀՀ քրեական դատավարության օրենսգրքի 35-րդ հոդվածի 2–րդ մասը ճանաչեց Սահմանադրությանը հակասող և անվավեր։ Այսպիսով արձանագրվեց, որ 35-րդ հոդվածի 2–րդ մասում նշված քրեական հետապնդումը բացառող հանգամանքների թվում անձեռնմխելիությանը վերաբերող կարգավորում առկա չէ, ինչը հակասահմանադրական է։
Նշենք, որ Մարտի մեկի գործով սահմանադրական կարգը տապալելու համար մեղադրվող ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանի եւ մյուս նախկին պաշտոնյաների գործով դատական նիստը նշանակվել է սեպտեմբերի 12–ին: Գործը մակագրվել է Երեւանի ընդհանուր իրավասության դատարանի դատավոր Աննա Դանիբեկյանին:
