2 ամիս առաջ ստեղծված միջգերատեսչական հանձնաժողովի վերջը չի երեւում. Մանվել Գրիգորյանի պաշտպան
POLITICSՄանվել Գրիգորյանի գործի հետ կապված ահազանգ եմ ուզում հնչեցնել, որը մեկ բառով կարող ենք բնութագրել որպես իրավական «բեսպրեդել»։ Այս մասին այսօր՝ սեպտեմբերի 2-ին, լրագրողների հետ հանդիպմանն ասաց գեներալ, ԱԺ նախկին պատգամավոր, ԵԿՄ նախկին նախագահ Մանվել Գրիգորյանի պաշտպանական խմբի անդամ Լեւոն Բաղդասարյանը։
«Այս տարվա հունիսին ՄԻԵԴ հայտնի որոշումից հետո, որ անհապաղ միջոցառումներ պետք է ձեռնարկել, որ Մանվել Գրիգորյանին տեղափոխեն քաղաքացիական հիվանդանոց, առողջապահության նախարարը հրաման արձակեց, օպերատիվ կերպով ձեւավորվեց բժշկական հանձնաժողով, որպեսզի հետազոտեն Գրիգորյանի հիվանդությունները, հետազոտելուց հետո հանձնաժողովի անդամները ահազանգեցին, որ գրանցվել է հիվանդությունների բացասական դինամիկա եւ գտնվում է ծայրահեղ ծանր վիճակում։ Դրանից հետո Մանվել Գրիգորյանը տեղափոխվեց «Նաիրի» ԲԿ, որտեղ եւս արձանագրեցին, որ առկա է բացասական դինամիկա, բարձրաձայնվեց, որ կարող է կյանքին վտանգ սպառնալ։ Այդ ընթացքում այնքան վատացավ Գրիգորյանի վիճակը, որ դարձավ անդամալույծ։ Պետական լիազոր մարմինները գուցե մտածելով, որ Գրիգորյանը «ստիմուլյանտություն» է անում եւ չի քայլում, բերեցին եւ տոկի տվեցին, բարձրաձայնեցին, որ ոտքերի 80-90 տոկոսը չի աշխատում»,–նշեց նա։
Փաստաբանի խոսքով՝ այսքանից հետո պետք է կալանքը փոխվեր, բայց այդպես չեղավ.
«Թվում էր, թե հիմքերը կային, որ խափանման միջոց կալանքը փոխվի, բայց մենք տեսանք, որ «կախյալ» դատարանը ոչ միայն չբավարարեց այդ միջնորդությունը, այլ բավարարեց մեղադրողի միջնորդությունը, որ ստեղծվի միջգերատեսչական հանձնաժողով։ Արդյոք առողջապահության նախարարի կողմից ստեղծված հանձնաժողովի եզրակացությունները բավարար չէին համապատասխան հետեւություն անելու համար։ 2 ամիս առաջ ստեղծված այդ հանձնաժողովի վերջը չի երեւում, ավելին՝ միջգերատեսչական հանձնաժողովի որոշմամբ եւ դատարանի կարգադրությամբ Գրիգորյանին 2-3 օրով տեղափոխեցին «Արմենիա» ՀԲԿ, որտեղ բժիշկները արձանագրեցին բացասական դինամիկա»։
Լեւոն Բաղադասրյանի խոսքով՝ դիմել են առողջապահության նախարարին՝ Մանվել Գրիգորյանին արտասահմանում բուժման թույլտվություն ստանալու համար. «Մոտ 2 ամիս առաջ պաշտպանական կողմը դիմել է առողջապահության նախարարությանը։ Դիմումին կցել ենք բոլոր հայտնի բժիշկների կարծիքները, որ Հայաստանի պայմաններում ուղղակի ոչ միայն հնարավոր չէ բուժել, այլ նաեւ գոնե կայուն վիճակն ապահովել, որպեսզի համապատասխան թույլտվություն վերցնենք, որ անձը արտերկրյա կլինիկայում բուժում ստանա, բայց այս պահի դրությամբ ունենք ոչ մերժում, ոչ բավարարում։ Սա խոսում է նրա մասին, որ Գրրիգորյանը ոչ թե կալանք է կրում, այլ պատիժ, վերջինիս նկատմամբ իրականացվում է տոտալ խոշտանգում բոլոր իրավական հետեւանքներով եւ, ցավոք, Մանվել Գրիգորյանի գործը ՄԻԵԴ տիրույթում է։ Պրակտիկայում աննախադեպ է, որ 3 անգամ ՄԻԵԴ–ը միջանկյալ որոշում կայացնի, ընդ որում որոշումներից մեկն էլ վերաբերում է առաջնահերթության կարգով անօրինական կալանքը քննելուն եւ խոշտանգման փաստին»։
