Դատարանը մեր հակափաստարկներից որեւէ մեկին չի անդրադարձել։ Այս մասին լրագրողների հետ զրույցում Գագիկ Խաչատրյանի փաստաբանական թիմի անդամ Երեմ Սարգսյանը՝ անդրադառնալով դատաքննությանը եւ դատարանի որոշմանը՝ կալանավորելու Գագիկ Խաչատրյանին։
«Մենք խորությամբ հակափաստեր ենք ներկայացրել, ընդ որում դրանք՝ գործի նյութերի եւ մեղադրանքի վերաբերյալ են։ Եվ այդ հակափաստարկների վերաբերյալ որեւէ հակառակ դիրքորոշում անհնար էր ներկայացնել, որովհետեւ գործում չկային այնպիսի նյութեր, որոնք կարող էին չեզոքացնել մեր հակափաստարկները»,- ասաց փաստաբանը։
Նա նշեց, որ չնայած ակնկալում էին, որ դատարանը արդեն նախկին շեմը հաղթահարել է ավելի օբյեկտիվ ու արդար կքննի, բայց «դատարանն անում է էն, ինչ ակնկալվում է իրենից»։
Ըստ փաստաբանի՝ դատաքննությունը ձեւական բնույթ էր կրում․ «Երեք օրվա քննությունն ընդամենը ձեւկան քննություն էր եւ որեէ նշանակություն չուներ, թե ինչ փաստեր են ներկայացվում, եւ արդյոք հակառակ կողմը կարողանում էր դրանք հերքել կամ չհերքել»։
Երեմ Սարգսյանը պնդեց, որ կալանավորման հիմքեր չկային, նշեց, որ ուղիղ 6 ամիս Գագիկ Խաչատրյանի խափանման միջոցը ստորագրությունն էր չհեռանալու մասին եւ այդ 6 ամսվա մեջ նա երբեւէ չի փորձել թաքնվել, երբեւէ չի խոչընդոտել քննությանը, երբեւէ նոր հանցանք չի կատարել․ «Թե ինչու հանկարծ մտավախություն ունեցան, որ կարող է թաքնվել, որեւէ պատճառաբանություն անհնար էր ներկայացնել։ Այսքան ժամանակ դատարանը մտավախություն չուներ եւ հանկարծ ունեցավ, որ կարող է մեղադրյալը թաքնվե՞լ, այսքան ժամանակ որ չի թաքնվել, հիմա՞ պետք է թաքնվեր։ Գագիկ Խաչատրյանն անգամ Երեւանից հասել է Ծաղկաձոր, մասնակցել խուզարկություններին, եթե փախչելու մտադրություն ունենար, չէր անի»։
Փաստաբանը հայտնեց, որ ըստ մեղադրանքի՝ վատնված գումարը, որի համար մեղադրվում է իր պաշտպանյալը, մոտ 200 միլիոն դրամ է, սակայն ըստ նրա՝ ինչ որ կատարվեց դատարանում, ընդհանրապես կապ չուներ իրավաբանության հետ․ «Դատարանի որոշման մեջ հիմնավորումներն ու պատճառաբանությունները, թե ինչու կալանվորվեց։ Ես ապշած եմ դատաքննության ընթացքից»։
Նա նշեց, որ անպայման բողոքարկելու են դատարանի որոշումը։
Հիշեցնենք, որ այսօր՝ օգոստոսի 30-ին, Երևանի ընդհանուր իրավասության դատարանը, նախագահությամբ Արտուշ Գաբրիելյանի որոշում է կայացրել բավարարել ԱԱԾ քննչական դեպարտամենտի քննիչի միջնորդությունը և երկու ամսով կալանավորել ՊԵԿ նախկին նախագահ Գագիկ Խաչատրյանին։ Դատարանը, սակայն ոչ իրավաչափ է համարել Խաչատրյանին ձերբակալելու որոշումը։
